NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Johnny L. Richardson and Starr E. Richardson, to John R. Lukens and Robert R. Harpold Jr., Trustee(s) dated June 14, 2000, and recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5002, at page 5024, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated August 27, 2014, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on August 24, 2016 at 1:30 p.m., at the front door of the courthouse of Raleigh County, West Virginia, the real estate conveyed by said deed of trust and situate in Beckley District, Raleigh County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 206 James Street, Beckley, West Virginia, and being more particularly bounded and described therein as follows: The surface of a certain lot or parcel of land, together with any improvements thereon and appurtenances thereunto belonging, located in the City of Beckley, Raleigh County, West Virginia, and being Lot No. 215 of the Hendrick-Walker-Carter Addition, in the City of Beckley, as shown on a map of said addition of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Map Book 1, at page 81, to which said map reference is here made for a more particular description of the lot or parcel of land hereby conveyed, said Lot No. 215 being located at the corner of Railroad Avenue and James Street. There is EXPECTED and RESERVED, however, and not hereby conveyed a portion of the aforesaid Lot No. 215, conveyed to Michael H. Brown and Ava Kylette Brown, his wife, by Donald M. Beckett and Patricia S. Beckett, his wife, by deed dated June 25, 1973: said deed recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 529, at Page 102, the portion of the said Lot NO. 215, not hereby conveyed, being bounded and described as follows: Beginning at a stake on the west line of James Street at the intersection of the north line of a twelve (12) foot alley; thence north line of twelve foot alley S 60 degrees 10′ W 86.60 ,feet to a stake, said stake being the back corner of lots Nos. 214 and 215, Hendrick-Walker-Carter Addition; thence with lot lines of Lot Nos. 214 and 215 N 29 degrees 50′ W 50.00 feet to a stake; thence through Lot No. 215 N 60 degrees 10′ E 78.76 feet to a stake in the west line of James Street; thence with line of James Street S 38 degrees 45′ E 50.61 feet to a point of beginning, containing 4,134 square feet and being a part of Lot No. 215, Hendrick-Walker-Carter Addition. And being the same property acquired by Donald M. Beckett and Patricia S. Beckett, his wife, by deed dated October 20,1970, from Bernard E. Cater and Georgia Carter, his wife, Lester R. Carter and Elizabeth Carter, his wife, and Margaret A. Carter, unmarried? recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 529, at page 94. Donald M. Beckett departed this life being a resident of Raleigh County, West Virginia, and be his Last Will & Testament, devised and bequeathed the aforementioned real estate unto his wife, Patricia Sheets Beckett, said Will recorded on Roll 2, at page 2225. And being the same property conveyed unto Johnny L. Richardson and Starr E. Richardson by a deed that is of record in the aforesaid Clerks office in Deed Book 5002, at page 5023. This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale. The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
