NOTICE OF TRUSTEE’S SALE

 

     NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 2050, at page 425 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

 

TUESDAY, FEBRUARY 5, 2019,

at 10:00 o’clock in the forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of URIAH PARKER, single, in and to the real property described in a certain deed of trust dated

September 29, 2005, to AYWARD E. MORRIS, original Trustee, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book

No. 1315, at page 499 thereof, possessed by the said URIAH PARKER as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:

Tract One:  Beginning on the westerly side of Swann Street at the point of Intersection of the southerly line of Columbia Avenue with the westerly line of Swann Street and running thence in a southerly direction with the westerly line of Swann Street 25 feet, more or less, to a point midway between the foundations of the house located upon the real estate adjoining on the southerly side of real estate hereby conveyed; thence in a westerly direction parallel with the line of Columbia Avenue 81 feet to a point; thence in a northerly direction parallel with the line of Swann Street, 25 feet, more or less, to a point in the southerly line of Columbia Avenue; thence in an easterly direction with the southerly line of Columbia Avenue 81 feet to the place of beginning.

 

This conveyance is made subject to any and all easements and rights of way that may now appear of record affecting said premises.

 

Tract Two:  Beginning at a point in the westerly line of Swann Street, 50 feet southerly from the Intersection of the westerly line of Swann Street and the southerly line of Columbia Avenue; thence in a northerly direction with the said westerly line of Swann Street, 25 feet, more or less, to a point midway between the foundations of the house located on the lot hereby conveyed and the house located on the lot adjoining the lot hereby conveyed on the north; thence at right angles and in a westerly direction and parallel with Columbia Avenue, 81 feet to a point; thence at right angles and in a southerly direction 25 feet, more or less, to a point; thence at right angles and in an easterly direction 81 feet to the place of beginning.

 

Being the same real property which was conveyed unto the party of the first part by Terry L. Ettinger, by Deed dated June 17, 1988, which was recorded in the Office of the Clerk of the County Commission in Book 862, Page 538.

 

AND believed to have a street address of 1011 Swann Street, Parkersburg, West Virginia.

 

The following terms will apply to said sale, to-wit:

 

  1. $5,000.00 in cash or certified funds at sale, with balance of bid price due within 10 days or as the Trustee and bidder(s) may otherwise agree at sale.
  2. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantors and their predecessors in title prior to the granting of the deed of trust being foreclosed upon.

3.The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.

4.The undersigned reserves the right to reject any and all bids.

  1. Sale is subject to unpaid ad valorem taxes and special assessments, if any.
  2. The premises and the unit of manufactured housing described hereinabove, including any and all improvements thereto, are sold âAS-IS WHERE ISã with no warranty express or implied.
  3. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
  4. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
  5. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
  6. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
  7. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
  8. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
