NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 14, 2000, executed by Borrowers, Beth Hudson and Danny L Hudson, to Heather Starcher, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 897, at Page 941. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Route 1 Tracewell Rd, Mineral Wells, WV 26150. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 28, 2018, of record in the Clerk’s Office in Book 2046, Page 729. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:
19th day of July, 2019 at 11:00 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Slate District, Wood County, West Virginia, and being more particularly described as follows:

Beginning at a point lying at the southwesterly intersection Tracewell Road, also known as County Road 14/9 and a 25á road running along the southerly line of Ferrellás Valley Addition of record in Plat Book 19, at Page 31 said point being a corner to the remainder of that same property as conveyed to Ira and Pearl L. Ferrell of record in Deed Book 621, at Page 246; thence along the southerly line of said 25á road S. 56 degrees 44á E. 370á to an iron rod set; thence leaving said road S. 33 degrees 16á W. 100á to an iron rod set; thence N. 56 degrees 44á W. 370á to an iron rod set; thence N. 33 degrees 16á E. 100á to the point of beginning containing a total of 0.85 acres, be the same, more or less, and being more particularly described on a Plat attached to General Warranty Deed to Danny L. Hudson and Beth Hudson, husband and wife, recorded November 29, 1995, in Deed Book 950, Page 643.
This conveyance is specifically made subject to any and all agreements, exceptions, restrictions, reservations, rights-of-way and easements of record in the aforesaid Clerkás Office pertaining to the above-described real estate.

Being the same property conveyed to Beth Hudson and Danny L Hudson by the Deed dated November 21, 1995 and recorded in Deed Book 950 at Page 643 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
