NOTICE OF TRUSTEE’S SALE

NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated June 2, 2003, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5009 at page 9018, executed by Robert Thompson and Vonda Thompson to Richard G. Rundle and Robert L. Milam, Trustees, securing Whitesville State Bank, which was given to secure the payment of the note therein described, and by Substitution of Trustee of record in the aforesaid Clerk’s office in Book 5071 at Page 2533 and demand having been made upon the undersigned so to do, the undersigned Substitute Trustee, Carl W. Roop will, on the 1st day of April, 2020, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:00 a.m., sell the following property:
Those certain lots or parcels of land, together with all improvements thereon, and subject to such rights and reservations, lying and being in Colcord, Clear Fork District, Raleigh County, West Virginia, described and bounded as follows:

TRACT ONE:
BEGINNING at a stone at the old cross fence on the Old Isaac Chapman Patent line and then running with the patent line to where it crosses the river; thence leaving the patent line and running up the river with its meanders to the back patent line to a stone; thence running down the river around the mountain side with the old patent line to a stone; thence running down the hill to an old chestnut stump at the old cross fence to the BEGINNING corner, containing thirty acres, more or less.

And being the same property conveyed to Robert Thompson and Vonda Thompson, husband and wife, by James A. Jarrell, single, by Deed dated June 24, 1997, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Instrument Roll 117, at Page 2757.

TRACT TWO:
BEGINNING at the barn gate and running a straight line across the bottom with the fence to the Chesapeake and Ohio Railroad, and thence running with the Chesapeake and Ohio Railroad to the upper end of the Zelda C. Jarrell tract, that is to say the upper end of that part of her said real estate where the Clear Fork of Coal River joins or meets with the Chesapeake and Ohio Railroad tract; thence down the river to the point of BEGINNING.

And being the same property conveyed to Robert Thompson and Vonda Thompson, husband and wife, by Virginia M. Jarrell, widow, by Joyce J. Blake, her attorney in fact, by Deed dated June 24, 1997, and of record in the aforesaid Clerk’s office in Instrument Roll 117, at Page 2767.

Said property will be sold upon the following terms and conditions:
1. Cash in hand on day of sale.
2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Substitute Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Substitute Trustee.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property.
6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property.
7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
