NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 26, 2018, executed by Borrower, Haley B Abbott, to Stephanie A Pfeifer, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1353, at Page 610. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 908 Old Bramwell Rd, Bluefield, WV 24701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 26, 2020, of record in the Clerk’s Office in Book 1387, Page 407. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

21st day of July, 2020 at 11:15 a.m.

PARCEL l: “All of the following piece, parcel or lot of land situate in Beaver Pond District, Mercer County, West Virginia, near the City of Bluefield, and more particularly bounded and described as follows, to-wit:
BEGINNING at a point on the Macadam Road 200 feet in a southeasterly direction from the corner of the lands formerly owned by George I. Smith and E. W. Horton, and running thence North 34deg. 45` East 180 feet more or less to the middle of an old road, known as Hale`s line; thence South 25deg. 16` East 59 feet more or less to a point, thence South 34deg. 45` West 150 feet more or less, to said Macadam Road; thence North 55deg. 15` West 50 feet to the point of BEGINNING, and being all of lot No. 5 and a portion of the land shown on plat as an alley on a map of Lots made for E. W. Horton by J. W. Bailey in September, 1919.”
“Less and excepting the following property, to-wit:
All of the following piece, parcel or lot of land situate in Beaver Pond District, Mercer County, West Virginia, near the City of Bluefield, and more particularly bounded arid described as follows, to-wit:
BEGINNING at a point being located N. 34deg. 45` E. 150 feet, more or less, from Macadam Road, set point in the Macadam Road being 200 feet in a southeasterly direction from a corner of the lands formerly owned by George I. Smith and E. W. Horton; thence N. 34deg. 45` E. 30 feet, more or less, to the middle of an old road, known as Hale`s line; thence S. 25deg. 15` E. 59 feet, more or less, to a point; thence in a southeasterly direction and through the property conveyed unto the party of the first part herein by Deed of Jimmy L. Shires, of record in Deed Book 848, at page 168, 50 feet, more or less, to the point of BEGINNING.” as set forth in current Deed and previous Deeds of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia.”
PARCEL 2: “The following piece, parcel or lot of land situate in Mercer County, West Virginia, on the Northeast side of the New Macadam Road leading from the City of Bluefield to the Town of Bramwell in said County, and being a portion of the 58 acres tract of land conveyed to E. W. Horton by W. L. Gibson and wife on December 13, 1916, which deed is of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Deed Book No. 110, page 253, and which is more particularly bounded and described as follows, to-wit:
Beginning at a point on the said New Macadam Road 250 feet in a Southeasterly direction from the corner of the lands owned by George I. Smith and those of the said party of the first part, and running thence North 34 deg. 45` East 120 feet to a stake; thence South 33 deg. 30` East 54 feet to stake; thence South 34 deg. 45` West 100 feet to said New Macadam Road; thence North 55 deg. 15` West 50 feet to the point of BEGINNING, and being Lot No. 6, as shown and designated and described on a Map of Lots made for E. W. Horton by J. W. Bailey, in September, 1919.”
PARCEL 3: “Engineering description of Parcel 46 Tax Map 30H located on State Route 11, Beaver Pond District, Mercer County, WV.”
“BEGINNING at a point in the northeast corner of Parcel 44 Tax Map 30H; said point being the northwest corner of the herein described tract; thence leaving Parcel 44 S 20 degrees 20 minutes 01 seconds E 61.17 (59Deed) ft.; thence along the dividing line of Parcels 46 and 47 S 34 degrees 45 minutes W 15 ft. to a point in the northeast corner of Parcel 45; thence along the dividing line of Parcels 45 and 46 N 33 degrees 30 minutes W 54 ft. to a point in the southern line of Parcel 44; thence along said Parcel 44 N 34 degrees 45 minutes E 30 ft. to the point of BEGINNING and containing 1129 sq. ft. more or less.

Being the same property conveyed to Haley B. Abbott by the Deed dated April 26, 2018 and recorded in Deed Book 1065 at Page 542 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
