NOTICE OF TRUSTEE’S SALE
Notice is hereby given that by virtue of the authority under that certain deed of trust executed by William R. Snyder and Suzanne M. Snyder, to Robert R. Harpold, Jr. and John R. Lukens, Trustee(s) dated January 16, 1998, and recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 127, at page 436, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated October 24, 2018, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on January 9, 2019 at 12:32 p.m., at the front door of the courthouse of Raleigh County, West Virginia, the real estate conveyed by said deed of trust and situate in Shady Spring District, Raleigh County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was 118 Oxley Circle, Beaver, WV 25815 and being more particularly bounded and described therein as follows:
Those two certain lots of land situate in Shady Springs District, Raleigh County, West Virginia, and being Lots Fifteen (15) and Sixteen (16) as shown on the revised map of Lots 15 to 20 inclusive of the Glen Hedrick Addition, recorded in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Deed Book 338, at page 166A (the map of the Glen Hedrick Addition being of record in the Clerk’s Office in Map Book 8, at Page 129), said lots being bounded and described as follows:
BEGINNING at a stake on the western side of River Side Road (now Elco Lane), said stake being common corner of Lots 16 and 17, and said stake being northwest 265.4 feet from the intersection of Blue Jay Road, thence with the line of Lots 16 and 17 S. 72deg. 15′ W. 65.5 feet to a stake on Big Beaver Creek; thence with the line of said Creek N. 5deg. 05′ W. 64.0 feet; N. 13deg. 33′ W. 51.0 feet to a stake, common corner of Lots 14 and 15; thence with a fence on the line of said lots N. 82deg. 20′ E. 61 feet to a post on Riverside Road (now Elco Lane); thence with the line of said Road, S. 9deg. 11′ E. 71.6 feet; S. 18deg. 16′ E. 31.6 feet to the place of beginning.
Being the same parcel of land conveyed to William E. Fritz, Jr. and Donna L. Fritz, by James William Small, Sr. and Betty Jo Small, his wife, by deed dated October 26, 1971 and of record in said Clerk’s Office in Deed Book 505, at page 265.
And being the same property conveyed to Suzanne M. Snyder by William E. Fritz, Jr. and Donna L. Fritz Matherly, by deed dated January 16, 1998, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 127, at page 502.
This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.
The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.
The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of the sale.
