Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Charles E. Clay, to Ottice R. Adkins and Carl W. Roop, Trustee(s) dated September 29, 2003, and recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5010, at page 7386, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated December 10, 2018, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on February 20, 2019 at 1:00 p.m., at the front door of the courthouse of Raleigh County, West Virginia, the real estate conveyed by said deed of trust and situate in Beckley District, Raleigh County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was 107 Elco Lane, Beckley, WV 25801 and being more particularly bounded and described therein as follows:
That certain lot of land situate in the City of Beckley, Raleigh County, West Virginia, and being Lot Four (4) of Elco Sub-division of an un-numbered tract of the Oak Grove Addition (the original map of said addition being of record in Deed Book 82, at page 283, and a revised map being of record in Map Book 7, at page 66, in the Office of the Clerk of the County Court of Raleigh County, West Virginia) as shown on a map prepared by P.H. Wilson, C.E., April 8, 1954, and of record in Map Book 10, at page 17, said lot being bounded and described as follows:
BEGINNING at a stake on the southern side of Elco Lane, line of said Lot 4 and the Combs Addition, thence with the line of Elco Lane N. 81deg. 44′ W. 36.07 feet, N. 0deg. 44′ E. 20.17 feet, N. 81deg. 44′ W. 50.43 feet to a stake, common corner of Lots 3 and 4, and said stake being southeast 117.38 feet to intersection of East Ridge Road; thence with the line of said lots 3 and 4 S. 0deg. 44′ W. 115.5 feet to the line of Lot 19 of the Oak Grove Addition; thence with the line of said lot 4 and 19 N. 73deg. 44′ E. 76.88 feet to a stake on the Combs Addition; thence with the line of said addition N. 11deg. 58′ E. 62.73 feet to the place of beginning.
And being the same property acquired by Charles E. Clay by Deed dated the 24th day of September, 2003 from Lou Ann Lushbaugh as Executive of the Estate of Virginia Bragg, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5010, at page 7383.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.
The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.
The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of the sale.
