NOTICE OF TRUSTEE’S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Sherri L. Willis, to Frederick A. Jesser, III and Charles E. Mahan, IV, Trustee(s) dated March 29, 2007, and recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5026, at page 3095, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated December 10, 2018, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on February 20, 2019 at 1:02 p.m., at the front door of the courthouse of Raleigh County, West Virginia, the real estate conveyed by said deed of trust and situate in Beckley District, Raleigh County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was 216 Garfield Street, Beckley, WV 25801 and being more particularly bounded and described therein as follows:
BEING the surface of that certain parcel of land located in the City of Beckley District of Raleigh County, West Virginia, being 0.157 ACRE located in BLOCK “K”, ROBERTSON ADDITION, as shown on a map dated November, 1995 prepared by Engineering Services, Inc., and recorded with a deed in the Office of the Clerk of the County Court of Raleigh County, West Virginia, on Roll 84, at page 157, and being more particularly described as follows:
BEGINNING at an iron pin (found) being the corner of the Lottis Grant Forbes Gilkerson (R28-134) parcel of land referenced South 66 degrees 44 minutes East 55 feet from the intersection of Garfield Street and Meadow Avenue; thence leaving the corner of said Gilkerson parcel of land and with the right of way of Garfield Street, South 66 degrees 44 minutes East 55.00 feet to a rebar being the corner of the Clyde L. and Ida Vest Hatcher (626-1) parcel of land; thence leaving the right of way of Garfield Street, and with the boundary line of the said Hatcher Parcel of land, S. 23 degrees 28 minutes West 125.00 feet to a rebar (set) a corner of said Hatcher parcel on the boundary line of the James D. and Phillip Allen Prince (WB 234-5) parcel of land; thence with the boundary line of the said Prince parcel of land, North 66 degrees 44 minutes West 54.50 feet to a rebar (set) a corner of the said parcel of land, more or less, and the Karen Thomley Glaize (710-203) and the said Gilkerson (R28-134) parcels of land; thence with the boundary line of the said Gilkerson parcel of land, North 23 degrees 15 minutes East 125.00 feet to the point of BEGINNING, containing 0.157 acres, more or less, as surveyed by Engineering Services, Inc., Beckley, WV.
AND BEING the same property conveyed unto Robert K. Canter, III from Beneficial West Virginia, Inc., by deed dated August 4, 2005, recorded in the Office of the Clerk of the County Court of Raleigh County, West Virginia in Book 5019, at page 2261.
THIS IS A PURCHASE MONEY DEED OF TRUST
SAID PROPERTY is conveyed unto Sherri L. Willis from Robert K. Canter, III, by deed recorded in the aforesaid Clerk’s Office in Deed Book 5026, at page 3093.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.
The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.
The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of the sale.
