NOTICE OF TRUSTEE’S SALE
NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated June 18, 2004, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5014 at page 1082, executed by Michael A. Welch to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 29th day of May, 2019, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:10 a.m., sell the property hereinafter described, which property was conveyed in said Deed of Trust, and being more particularly described as follows:
That certain tract or parcel of land, and all appurtenances thereunto belonging, situated near Princewick, in the Slab Fork District, Raleigh County, West Virginia, and more particularly bounded and described as follows:
BEGINNING at a 14 inch diameter Locust tree located on the north bank of a dirt access road, said 14 inch diameter Locust tree being a common corner of Parcel 85.1, Tax Map 11 and Parcel 86.0, Tax map 11 (Robert J. Billips and Gloria V. Billips, Deed Book 637, Page 487); thence with the western boundary line of said Parcel 86.0, South 14deg. 23′ 35″ West, 369.06 feet to a roof bolt, the southwest corner of said Parcel 86.0 and the northwest corner of Parcel 84.0, Tax Map 11 (Evelyn Holliday Shrewsbury, Roll 111, page 1446); thence with the western boundary line of said Parcel 84.0 the following two (2) bearings and distances: 1) South 20deg. 00′ 00″ West, 456.34 feet to a 39 inch diameter Chestnut Oak tree, 2) South 25deg. 14.51″ West, 512.00 feet to a stone on a hillside near the top of a ridge, the southwest corner of said parcel 84.0, said stone also being a point in the northern boundary line of said Parcel 54.0, Tax Map 8 (Piney Land Company, Deed Book 749, Page 783); thence with the northern boundary line of said Parcel 54.0, North 75deg. 11′ 08″ West, 793.02 feet to an iron rail, the southeast corner of parcel 70.0, Tax Map 8 (Consolidation Coal Company, Deed Book 450, page 240); thence with the eastern boundary line of said Parcel 70.0, the following three (3) bearings and distances: 1) North 5deg. 20′ 34″ West, 147.12 feet to a 34″ diameter Chestnut Oak tree on a point, 2) North 24deg. 44′ 42″ East, 502.05 feet to a 1/2 inch iron rebar, 3) North 46deg. 55′ 10″ East, 638.90 feet to a 3″ treated fence post, the northeast corner of said Parcel 70.0, said 3 inch treated fence post being a common corner of Parcel 68.0, Tax Map 8 (John H. Crawford and Dennison Crawford, Roll 111, page 236), and said Parcel 85.1; thence with the south line of said Parcel 85.1 the following two (2) bearings and distances: 1) North 80deg. 47′ 03″ East 464.06 feet to a 1/2 inch iron rebar, 2) South 59deg. 13′ 01″ East, 130.00 feet to the point of BEGINNING.
And being the same property acquired by Michael Welch, by Deed dated the 5th day of April, 2004 from Scottie Gene Richardson, which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5012, at page 8010.
Said property will be sold upon the following terms and conditions:
1. Cash in hand on day of sale.
2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property.
6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property.
7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
