NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 30, 2002, executed by Borrowers, Catherine L Gordon and Curtis D Gordon, to James B. Crawford III, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5007, at Page 5969. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 107 Pella Lane, Pemberton, WV 25878. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 16, 2018, of record in the Clerk’s Office in Book 5067, Page 5056. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Town District, Raleigh County, West Virginia, and being more particularly described as follows:
That certain tract or parcel of land containing 1.031 acres, more or less, situate at Pemberton, Town Tax District, Raleigh County, West Virginia, as shown on that certain map entitled “Plat of 1.031-Acre Tract at Pemberton, Town District, Raleigh County West Virginia Being a Part of a 10.0-Acre Tract Standing in the Names of E. C. Hungate, Jr., and Marietta Hungate By James E. Cook, P.E. May 9, 1994 Scale: 1″ = 100” of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.
BEGINNING at a point on the eastern right of way line of Spring Street at the southern intersection to a 30-foot street, said point being the northwestern corner to Lot 27 of the Phillips Section of Pemberton; thence following the northern boundary of Lot 27 along said 30-foot street right of way line S 61deg. 48′ E 151.70 feet to the intersec on of a second 30-foot street; thence following the western right way line of said 30-foot street, S 28deg. 24′ W 273.60 feet; thence following the end of said street, S 62deg. 33′ E 30.00 feet to a point on line of Western Pocahontas Land Company; thence following said Western Pocahontas, S 28deg. 24′ W 243.09 feet to the eastern right of way line of Chestnut Street; thence following the eastern right of way line of relocated Chestnut Street the following four (4) calls: N 03deg. 25′ E 121.61 feet, N 05deg. 35′ E 72.77 feet; N 08deg. 03′ E 73.55 feet; N 11deg. 20′ E 258.77 feet to the eastern right of way line of Spring Street; thence following said right of way line, N 28deg. 11′ E 20.94 feet to the point of beginning, and containing 1.031 acres, more or less.
Being the same property conveyed to Catherine L Gordon and Curtis D Gordon by the Deed dated April 9, 2012 and recorded in Deed Book 5006 at Page 9103 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
