NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell that property secured by that certain Deed of Trust dated September 17, 2010, executed by Teresa A. Hicks to Marc J. Slotnick, Trustee, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5040, at Page 9553. The borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on:
WEDNESDAY,
JANUARY 30, 2019,
AT 10:00 O’CLOCK A.M.

All that certain lot, parcel and tract of real estate situate in Shady Spring District, Raleigh County, West Virginia, being a portion of LOT NUMBER TWENTY-SIX (26) of the Beaver Creek Farms, a subdivision, as shown upon a map thereof entitled “Map of Beaver Creek Farms situate just east of Highway 19-21 Shady Springs District, Raleigh County, West Virginia Scale 1″ = 100′ April 9, 1941 B. B. Gunnoe, Engr.” which said map is of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Map Book No. 8, at page 15, and to which said map reference is here made and made a part hereof for a more particular description of the property herein conveyed. Said portion hereby conveyed with improvements thereon being described as follows:
Beginning at a point in the boundary line of Cook Street (which is a mutual corner of Lots Nos. 26 and 28 as shown upon the above mentioned map), thence following the common boundary of said Lots No. 26 and 28, northeastwardly, for a distance of 145.5 feet to a common corner Lot No. 28 and Lot No. 27; thence at an angle southward through the interior of Lot No. 26 in a straight line a distance of 203 feet to a stake, which is located 81.5 feet from the boundary of Cook Street; thence at right angle, southwesternly or westernly in a straight line to the boundary line of Cook Street; thence N 42-30 W following the boundary of Cook Street a distance of 203 feet to the point of beginning, being shown by rough diagram on a portion of above mentioned map, attached hereto.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 258 Trump Street, Daniels, West Virginia 25832.

And being the same property conveyed unto Teresa Ann Hicks by Deed dated March 9, 1988, of record in the aforesaid Clerk’s office in Deed Book 730, at Page 651.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee by cashier’s check, cash or money order within thirty (30) days of the date of sale, with a minimum deposit of $1,400.00 payable to the Trustee by cashier’s check, cash or money order at the time and place of the sale.
