NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 8th day of September 2006, signed by David B. Wobo and Carmen N. Wobo, to Richard Pill, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5023, at page 8140, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 3:00 o’clock p.m. on the 28th day of APRIL 2015 at the front doors of the Courthouse in Raleigh County in Beckley, West Virginia the following described real estate: That certain tract or parcel of land lying on the waters of Sand Branch, a tributary of Paint Creek, Town District, Raleigh County, West Virginia, and bounded an more particularly shown on the attached map as Tract A, and described as follows, to wit: Beginning at a found T-rail in a fence line at the corner common to a tract now or formerly owned by Richard L. and Carol K. Busick (Roll #108 Page 2160) and a tract now or formerly owned by Judy Ann and Frankie Lee Perry (Roll #84 Page 2648); said point of beginning being referenced S. 22 20′ 1″ E. 0.27 feet to a found 6 1/2″ x 4″ set stone and also being referenced S. 50 09″ 29″ W. 242.50 feet to a found 1 1/2″ x 3 1/2″ steel rail at a fence corner; thence leaving the Busick tract and running with the Perry tract N. 20 48′ 20″ W. 383.98 feet to a found T-Rail in a fence line and being a corner common to the Perry tract and a tract owned now or formerly by James R. and Rebecca A. Ormandy; thence leaving the Perry tract and running with the Ormandy tract N. 37 44′ 24″ E. 219.60 feet to a set 1/2″ rebar at the corner of Tract B; thence leaving the Ormandy tract and running into and through the Murdock tract for a new line with Tract B, S. 31 57 47″ E. 452.89 feet to a set 1/2″ rebar, thence leaving Tract B S 58 02′ 13″ W. 280.27 feet to the point of beginning and containing 2.28 acres. Tract A is also subject to a 40 foot right of way for the purposes of ingress and egress that is more particularly described as follows: Beginning at a found T-Rail in a fence line at the corner common to the Richard L. and Carol K. Busick tract and the Judy Ann and Frankie Lee Perry tract and also being the Point of Beginning of Tract A; thence leaving the Busick tract and running with the Perry tract, N. 20 48′ 20″ W 40.77 feet to a point; thence leaving the Perry tract and the fence and running into and through Tract A. N 58 02′ 13″ E. 272.38 feet to a point on line of Tract B; thence running with Tract B S 31 57′ 47″ E. 40.00 feet to a set 1/2″ rebar at the corner common to Tract A and B being on line of the above-mentioned Busick tract; thence leaving Tract B and running with the Busick tract S. 58 02′ 13″ W. 280.27 feet to the point of beginning and containing 11, 052.92 square feet or 0.25 acres. There is GRANTED and CONVEYED a nonexclusive right of ingress and egress for unrestricted access on and over that certain established thirty foot right of way leading from WV Rt. 19/3 and commonly known as Sand Branch Road in Town District, Raleigh County, West Virginia, to that certain 2.288 acre tract heretofore conveyed to the Grantess by the Grantors by deed dated May 23, 2000 and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia as document 5002/4065, said right of way being more clearly shown on a map entitled “Property Map showing division of Oie Williams property, January 27, 1981, Dennis J. Lilly, land surveyor”, which plat is of record in the aforesaid Clerk’s Office in Map file 2 – 121B. The Grantors herein reserve unto theirselves, their successors and assigns the right to use said right of way in conjunction with the Grantees. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 172 Williams Street Mount Hope, West Virginia 25880 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same.
