NOTICE OF TRUSTEE’S SALE
PUBLIC AUCTION

In execution of a certain Deed of Trust dated September 12, 2013, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Roll 5052, at Page 9471, given by Watus L. Dow and Brenda G. Dow, husband and wife, to Douglas B. Ernest and Charles J. Mildren, Trustees, for United Bank (formerly United Bank Inc); said Trustees failing to perform, Paul O Clay, Jr, Successor Trustee was appointed as evidenced by that certain Removal of Trustee and Substitution Thereof, dated December 5, 2018, and recorded in the aforesaid Clerk’s Office in Roll 5068, at Page 7728; default having been made in the payment of the debt therein secured; and upon failure to cure said default; and being required by the beneficiary so to do, the undersigned Successor Trustee will sell at public auction at the front door of the Courthouse of Raleigh County, Beckley, West Virginia, on Wednesday April 3, 2019, at 10:30 o’clock a.m., the following described real estate situate in Town District, Raleigh County, West Virginia, and being more particularly bounded and described as follows, to-wit:
The following described lot or parcel of surface land, together with the improvements thereon, appurtenances thereunto belonging and rights incidental thereto, situate in the New River Subdivision No. 3, Town District, Raleigh County, West Virginia, and being more particularly bounded and described as follows, to-wit:
BEGINNING at a hub on the western edge of a 30 foot street, aforesaid hub lying N 7-00′ W 125.01 feet from the northern right of way line of a 16 foot blacktop road, designated as West Virginia Secondary Road, Route 19 over 1 and also lying S 85-24′ W 30 feet from the former line between Lots 32 and 31 of Blackburn Patteson Realty Company’s New River Subdivision No. 3; thence through Lots 31 and 30 of aforesaid subdivision, by a new line hereby established, by the four following courses and distances: S 83-00′ W 160.10 feet to a hub set N 81-45′ E 10.00 feet from the former common line between Lots 29 and 30 of aforesaid subdivision; thence N 7-00′ W 110.83 feet to a hub lying N 83-00′ E 10 feet from the before mentioned line between Lots 29 and 30 of the aforesaid subdivision; thence through Lots 30 and 31 of aforesaid subdivision N 83-00′ E 160.30 feet to a hub on the western edge of a 30 foot street, said hub also being S 85-24′ W 30 feet from the former line between Lots 31 and 32 of aforesaid subdivision; thence along the western edge of the 30 foot street S 7-00′ E 110.83 feet to the beginning, containing 17,749 square feet, or 0.45 acres, more or less.

And being the same property conveyed unto Watus L. Dow and Brenda G. Dow, by deed of Clarence H. Emerson and Betty L. Emerson, his wife, dated May 12, 1999, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Roll 160, at page 374.
The above described real estate will be conveyed by the undersigned Successor Trustee to the purchaser thereof by deed containing a covenant of SPECIAL WARRANTY and subject to all liens, reservations and exceptions appearing in the record title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid Deed of Trust.
The Successor Trustee herein asserts, to the best of his knowledge and belief, that the parties in interest are not members of the Armed Forces of the United States, and are therefore not entitled to the benefits of the Service Members Civil Relief Act.

REAL ESTATE TAXES:
Subject property will be sold by the undersigned Successor Trustee subject to real estate taxes presently a lien against subject real property. Any purchaser shall purchase subject to, and be responsible for, said real estate taxes.
TERMS OF SALE:
Cash on hand on day of sale. The above described real estate will be sold by the undersigned Successor Trustee by auction to the highest bidder subject to the right of the Successor Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above described Deed of Trust and the owner of any other interest in the property to be sold shall have the right to bid.
CONTINUANCE OR
ADJOURNMENT OF SALE:
The Successor Trustee reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice and announcement at the time and place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
