NOTICE OF TRUSTEE'S SALE Pursuant to the authority vested in the undersigned Trustee by Deed of Truist dated September 14, 2020, executed by Joshua James Martin and Destiny Rose Fiorenza to Joel P. Jones, Jr. and J. Patrick Jones, Trustee, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2796 at Page 597, the undersigned Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Trustee will sell the real estate described in the Deed of Trust, at a public auction on October 1, 2025 at 10:00 a.m. to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: PARCEL NO.1 All that certain strip, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on the revised map of the said City of Huntington, made by L. W. Leete, Civil Engineer, filed in the office of the Clerk of the County Commission of Cabell County, West Virginia, on the 31st day of December, 1903, which strip, piece or parcel of land, being 6 feet wide and 30 feet long, leading from the Lot Number Sixteen (16) in Block Number Forty-three (43) of the aforesaid map, and running to Fifth Street and adjacent to the north of the corner lot, between the lot above referenced to and Fifth Street. PARCEL NO. 2 An easement to the said Grantee, for the use of the rear of the property formerly belonging to John L. Hash and Mary Jo Hash, his wife, for maneuvering, turning, and all of the uses incident to the using of the rear of lot parking facility. It is understood that this easement shall last so long, and only so long as the rear of the premises is being used as a parking facility. PARCEL NO. 3 All that portion of the that certain lot of ground, situation in the City of Huntington, Cabell County, West Virginia, known and designated on a revised map of said City, made by L. W. Leete, Civil Engineer, which map was filed on the 31st day of December, 1903, as LOT NUMBER FIFTEEN (15) in BLOCK NUMBER FORTY-THREE (43), bounded and described as follows: BEGINNING at the southeast corner of Lot Fifteen (15) at the point of intersection of Fifth Street and Fifth Avenue; thence in a northerly direction, along the east side of Fifth Street, 103 feet to a point; thence in a westerly direction, 30 feet to a point; thence in a southerly direction, parallel with Fifth Street, 103 feet to a point in the north line of Fifth Avenue, thence in an easterly direction 30 feet to the BEGINNING. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in "AS IS" condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7.
