NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated April 8, 2015, from James Edward Ferrell, Jr. to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia on Roll No. 5058, at page 3687, securing a promissory note in the principal amount of $82,851.67, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Raleigh County Courthouse in Beckley, West Virginia on June 19, 2019 at 8:30 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, being a tract of land near Stover in Trap Hill District, Raleigh County, West Virginia located in Elliott Estates and situated on the south side of State Route 3 and 1,100 feet southeast of the intersection of County Route 3/13 and being more particularly described as follows: (all bearings are referenced to the magnetic meridian and distances are horizontal):
BEGINNING at AEP power pole #796-C13 located 20 feet from the centerline of State Route 3 on the south side and 1200 feet south east of the intersection of State Route 3 and County 3/13, said point being a common property corner with Russell & Patricia Steel, thence following the Steel line S 40deg. 23′ 40″ W and passing through a 1/2″ reference rebar found at 5.00 feet located at the northeast base of a fence post, at total distance of 147.19 feet to a 5/8″ rebar found, thence continuing along the right fork of Sand Lick Creek the following 4 calls: N 53deg. 46′ 35″ W 69.22 feet to a point in the creek, thence N 79deg. 51′ 43″ W 181.16 feet to a point in the creek, thence N 63deg. 07′ 27″ W 142.79 feet to a point on the North side of the creek, thence N 82deg. 54′ 18″ W 93.04 feet to a 5/8″ rebar found, being a common corner with Plot 4 of Elliott Estates and with Russell & Patricia Steel, thence leaving the Steel line and following the common line with Plot 4 N 22deg. 31′ 29″ E 230.48 feet to a point in the center of Euston Drive and passing through a 5/8″ reference rebar found on line at 219.94 feet, said point being a common corner with the Melissa Stover tract, thence following said tract along the center of Euston Drive and leaving Plot 4 S 49deg. 09′ 24″ E 288.37 feet to a point, thence leaving Euston Drive N 40deg. 50′ 36″ E and passing through a 5/8″ reference rebar found at 10.00 feet a total distance of 132.64 feet to a 5/8″ rebar found 20 feet from the centerline of County Route 3 on the south side, thence leaving the Melissa Stover tract and following the right-of-way of County Route 3 S 44deg. 02′ 22″ E 224.50 feet to the point of BEGINNING containing 2.0 acres more or less as surveyed by Alpha Engineering Services, Inc. of Beckley, West Virginia in May, 2007.
Being the same property conveyed from Vanderbilt Mortgage and Finance, Inc. to James Edward Ferrell, Jr. by Deed dated April 3, 2015, of record in the aforesaid Clerk’s office on Roll No. 5058, at page 3684.
Terms of the sale: Ten percent nonrefundable cash deposit due at time of sale. Ninety percent balance of purchase price due within thirty days of date of sale.
