Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

offer for sale certain property described in that certain deed of trust given by Valley Meadow Estates, LLC to David A. Sims, as Trustee, which deed of trust is dated the 8th day of February, 2007, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 423, at Page 43, and given to secure Valley Meadow Estates, LLC, the payment of a note therein described.

By Substitution of Trustee dated the 31st day of March, 2016, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 544, at Page 479, Gregory R. Tingler was appointed Substitute Trustee. Said property is described as follows:

A tract of land situate in Beverly District, Randolph County, West Virginia, on the waters of the Tygart Valley River, more particularly described as follows:

BEGINNING at a 3/4” iron rebar (found), being in the western right of way line of West Virginia County Route 23, and being a corner to Valley Meadow Estates’ 2.300 acre tract (500/44), from which a 3/4” iron rebar (with cap, found) is N 67 05 52 E 49.53 feet, thence leaving said Route 23 and with said 2.300 acre tract

S 67 05 52 W at 154.14 feet passing through a 3/4” iron rebar witness (found), in all 201.61 feet to a 3/4” iron rebar (set), being in the line of said 2.300 acre tract, from which a 5/8” iron rebar (found) is S 67 05 52 W 315.84 feet, thence entering said 2.300 acre tract with seven (7) lines of partition

N 12 30 56 W at 92.05 feet passing through a 3/4” iron rebar (set as a witness) in all 104.05 feet to a point in the centerline of a private twenty foot (20’) wide ingress and egress easement and right of way, thence with the centerline of said right of way for six courses and distances

N 79 06 27 E at 3.91 feet passing a point in the centerline of said right of way, being a corner to a tract of land carved out this day, being a part of said 2.300 acre tract and designated as Lot #3, in all 53.24 feet to a point in the centerline of said right of way and with a curve to the right, having as its elements a radius of 64.15 feet and a chord bearing

S 1 55 35 E 120.26 feet to the beginning, containing 0.364 acres (gross area), more or less, as surveyed by Robert A. Kitzmiller, Professional Surveyor #635, of Buckhannon, West Virginia.

THERE IS EXCEPTED from this conveyance one half of a twenty foot (20’) wide ingress and egress easement and right of way, being measured ten feet (10’) perpendicular to and at right angle to the centerline of said right of way, being 0.074 acres, more or less, leaving a net area of 0.290 acres, more or less.

Being the same real estate which was conveyed unto the Grantor herein, Karen Underwood, Single, from Valley Meadow Estates, LLC, A West Virginia Corporation, by Deed dated the 6th day of February, 2007, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia in Deed Book 514 at page 197

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down), or approved line of credit with closing to occur within thirty (30) days.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
