NOTICE OF SUCCESSOR TRUSTEEáS SALE

OF REAL PROPERTY

 

Notice is hereby given that, by virtue of the authority vested in the undersigned Steven M. Condaras, as Successor Trustee, by that certain A Credit Line Deed of Trust and Security Agreement made and executed by Jeffrey L. Evans to BB&T Collateral Service Corporation, a West Virginia corporation, as Trustee, dated October 21, 2005, and recorded in the office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 1320, page 801 (the âDeed of Trustã); and the said Steven M. Condaras, acting as Successor Trustee under and by virtue of a certain Appointment of Successor Trustee dated September 24, 2014, and recorded in said Clerk’s Office in Trust Deed Book 1840, at Page 397; and default having been made in the payment of the note secured by said Deed of Trust, and such default having continued for a period of more than thirty days; and Branch Banking and Trust Company, the owner and holder of said note, having elected to treat the whole principal debt secured by said Deed of Trust as immediately due and payable and having requested in writing the sale of the real estate conveyed by said Deed of Trust;

NOW, THEREFORE, the undersigned Successor Trustee, having been required so to do by said holder, Branch Banking and Trust Company, a North Carolina banking corporation will sell the real estate conveyed by said Deed of Trust at public auction to the highest bidder at the front door of the Courthouse of Wood County, West Virginia, in the City of Parkersburg, West Virginia, on January 15, 2015, at 11:30 a.m., local time, and which said real estate is located in the City of Parkersburg, Wood County, West Virginia, and more particularly described as follows:

 

BEGINNING at the southeasterly corner of the intersection of Forest Road and Sherwood Drive, said point being S. 69õ 40’ E. 262.86 feet from an iron rod located on the easterly edge of West Virginia Route No. 47; thence S. 69õ 49’ E. with the southerly edge of Forest Road 101.08 feet to a point which is the corner to Robert H. Chichester, et us; thence in a southerly direction with the westerly line of said Chichester lot 147.64 feet, more or less, to a point; thence N. 69õ 49’ W. 60.00 feet to a point on the easterly edge of Sherwood Drive; thence N. 9õ 41’ E. 149.50 feet to the beginning and being all of Lot No. 5 as shown on a plat prepared by Arden L. Marshall, Surveyor of Abbey Village, which said plat is not of record.

 

There is also conveyed herein the right of ingress and egress over those certain rights of way or private drives known as Forest Road and Sherwood Drive.

 

There is also conveyed herein the equal right to use the sanitary sewer system with lagoon, which is located upon the original 13.10 acre tract, conveyed unto Pete Jones in Deed Book 617, at page 389.

 

This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

And being the same property conveyed to Jeffrey L. Evans by the following deeds: (i) by Deed dated June 3, 2003, and recorded in said Clerk’s Office in Deed Book 1054, at Page 125; and (ii) by Deed dated August 29, 2005, and recorded in said Clerk’s Office in Deed Book 1086, at Page 660.

The above-described real estate will be conveyed by the undersigned Trustee by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts/ municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way, easements and other matters of record in the aforesaid Clerkás office and affecting the subject real estate, and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale.

 

TERMS OF SALE

 

  1. Cash in hand on day of sale or cancellation of existing indebtedness in the discretion of the Successor Trustee;
  2. Subject to any senior in priority deed of trust or security agreements of record;
  3. Subject to any special assessments or any liens for taxes;
  4. The above-described real estate will be sold by the undersigned Trustee, or his agent, by auction to the highest bidder subject to the right of the undersigned Trustee to reject all bids if, in his opinion, said bids are inadequate; and,
  5. The owners of the indebtedness secured by the above-described deed of trust shall have the right to bid.
  6. The sale shall be without representation or warranty of any kind, express or implied.

 

CONTINUANCE OR ADJOURNMENT OF SALE

 

The undersigned Trustee, or his agent, reserves the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
