NOTICE OF TRUSTEEàS SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated June 22, 2005, executed by Borrowers, Harold Cottrell and Amanda Cottrell, to Vance Golden, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1294, at Page 422. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2905 Beeman Rd, Washington, WV 26181. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 3, 2014, of record in the Clerkàs Office in Book 1842 at Page 666. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Harris District, Wood County, West Virginia, and being more particularly described as follows:

BEGINNING at a point in the center line of Beeman Road (C.R. 11/2), said point being the southeast corner of a tract of land conveyed to John W. Satow in Deed Book 468, at page 344; thence with the southern line of said Satow; N. 80 degrees 37á 11ã W. 156.96 feet to a 1/2ã iron rod set, passing a reference fence post at 15.1’; thence N. 30 degrees 26á 36ã E. 119.16 feet to a 1/2ã iron rod set; thence N. 60 degrees 38á 36ã E. 157.61 feet to a 1/2ã iron rod set; thence S. 48 degrees 24á 20ã E. 81.63 feet to a point in the center line of Beeman Road, passing a 1/2ã iron rod set at 66/63 feet; thence with the said line, S. 25 degrees 50á 26ã W. 55.92 feet to a point; thence S. 33 degrees 05á 40ã W. 60.32 feet to a point; thence S. 42 degrees 41á 57ã W. 68.75 feet to the place of beginning, and containing 0.683 acres, being âTract 1ã shown on the plat dated November 6, 1999, prepared by Stephen M. Eaton, Licensed Professional Surveyor No. 1964, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1007, at page 118.

 

Being the same property conveyed to Harold Cottrell and Amanda Cottrell by the Deed dated June 22, 2005 and recorded in Deed Book 1083 at Page 600 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

 

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

 

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
