NOTICE OF TRUSTEEàS SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated January 7, 2010, executed by Borrower, April D. Long, to Stephen L. Thompson, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1588, at Page 406. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1025 Marrtown Rd, Parkersburg, WV 26101. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 3, 2014, of record in the Clerkàs Office in Book 1851, at Page 280. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

February 13, 2015 at 3:21 p.m.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and being more particularly described as follows:

 

Situate in the District of Lubeck, County of Wood, and the State of West Virginia, more particularly bounded and. described as follows, to wit:

 

TRACT NO. 1: BEING all of Lots Nos. Twenty-three (23) and Twenty-four (24) of Bickel Estates No. 1, a plat of which is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 14, at page 20, to which plat reference is here made and had for a more particular description of said lots.

 

LESS and EXCEPTING from Lot No. Twenty-three (23) above described that certain five-foot strip of land conveyed to Paul Beckner, et al, Trustee of the First Church of the Nazarene, by F. L. Morehead, et ux., by Deed dated June 21, 1983, and of record in said Clerkás Office in Deed Book 789, at page 171.

 

TRACT NO. 2: BEGINNING at the southerly common corner of Lots Nos. Seventeen (17) and Twenty-four (24) of Bickel Estates No. 1; thence S. 23õ 28á W. 20 feet to a point; thence in a line parallel with the northerly line of Lot No. Twenty-four (24) and 20 feet southerly therefrom, 109 feet, more or less, in a westerly direction to a point in the easterly right of way line of Marrtown Road; thence N. 23õ 2W E. 20 feet to a concrete marker in the southerly line of Lot No. Twenty-four (24); thence, with the southerly line of Lot No. Twenty-four (24), 109 feet, more or less, in an easterly direction to the place of beginning, being a 20-foot strip of Tract A of Bickel Estates No. 1.

 

BEING the same real estate conveyed unto April D. Long by a Deed dated November 19, 2009, and to be recorded in the aforesaid Clerkás Office immediately prior hereto.

 

This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

Being the same property conveyed to April D. Long by the Deed dated November 19, 2009 and recorded in Deed Book 1149, at Page 491 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

 

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

 

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
