NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 25, 2006, executed by Borrower(s), Patty E Owens and James A Owens, to William B. Summers, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1386, at Page 430. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 7 Dogwood Estates, Mineral Wells, WV 26150. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 31, 2017, of record in the Clerk’s Office in Book 1982, Page 68. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Slate District, Wood County, West Virginia, and being more particularly described as follows:
All of that certain lot, tract or parcel of land lying and being situate in the District of Slate, County of Wood, and State of West Virginia, and more particularly described as follows:
Beginning at a 1/2 inch iron rebar set in the westerly line of Brandi Drive said iron rebar being at the easterly common corner of Lots 6 and 7 of the hereinafter mentioned Addition; thence leaving Brandi Drive, North 57 degrees 54 minutes 09 seconds West, 138.91 feet to a 1/2 inch iron rebar set at the westerly common corner of said Lots 6 and 7 of said Addition; thence with the westerly line of Lot 7 of said Addition two courses and distances as follows: North 31 degrees 55 minutes 14 seconds East, 80.49 feet to a 1/2 iron rebar set, North 31 degrees 40 minutes 38 seconds East, 17.15 feet to a 1/2 inch iron rebar set at the westerly common corner of Lots 7 and 8 of said Addition; thence with the common line of said Lots 7 and 8, South 57 degrees 54 minutes 13 seconds East, 139.29 feet to a 1/2 inch iron rebar set in the westerly line of Brandi Drive at the easterly common corner of said Lots 7 and 8; thence with the westerly line of Brandi Drive, South 32 degrees 05 minutes 51 seconds West, 97.63 feet to the beginning, containing 0.312 acres, more or less, and being all of Lot 7 of Dogwood Estates as shown on a Plat of same by Scott F. Stewart, Professional Surveyor, dated October 4, 1999.

Being the same property conveyed to Patty E Owens and James A Owens by the Deed dated October 19, 1999 and recorded in Deed Book 1039 at Page 399 in the Office of the Clerk of the County Commission of Wood County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
