NOTICE OF TRUSTEEáS SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 25, 2010, executed by Borrower(s), Tara L Marks and William T Yates III, to Vance Golden, Attorney/Golden and Amos the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1609, at Page 150. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 8304 Wadesville Rd, Mineral Wells, WV 26150. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 23, 2017, of record in the Clerk’s Office in Book 1985, Page 663. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:
13th day of November, 2017 at 11:00 a.m.
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Steel District, Wood County, West Virginia, and being more particularly described as follows:
Situate District of Steel, County of Wood, State of West Virginia
Beginning at a point lying in the center of Wadesville Road, said point being the common corner to the second tract of property as conveyed to Linda J. Christie of record in Deed Book 1090 at Page 516 and Allen C. Tennant of record in Deed Book 1083 at Page 346, reference an iron pipe found lying South 79 degrees 30 Minutes West (bearing reference a Survey by James Dixon, WV LS, of record in Deed Book 615 Page 548) a distance of 22.8 feet on the common line of said Christie and Tennant.
THENCE with said road two calls;
1.) South 06 degrees 50 minutes 36 seconds East 127.16 feet to a point
2.) South 16 degrees 34 minutes 22 seconds East 157.76 feet to a near the center of a small bridge.
THENCE leaving said road crossing the north Fork of Lee Creek at 25 feet (plus or minus) South 69 degrees 58 minutes 50 seconds West for a distance of 254.29 feet to an iron rod set.
THENCE North 23 degrees 12 minutes 27 seconds West for a distance of 227.86 feet to a 20 inch Poplar Tree corner.
THENCE North 76 degrees 00 minutes 43 seconds West for a distance of 39.28 feet to a 20 inch Poplar Tree corner.
THENCE North 16 degrees 05 minutes 26 seconds East passing 2.5 feet Westerly of the Northwest corner of a barn for a total distance of 97.60 feet to a iron rod set near the center of a small run and lying in the above mentioned common line of Christie and Tenant.
THENCE with, said common line of Christie and Tenant North 79 degrees 30 minutes East passing over said North Fork of Lee Creek, then an iron pipe found at 261.59 feet for a total distance of 284.39 feet to the point of beginning containing a total area of 1.97 acres and being part of the First and second tract of property as conveyed to above mentioned Linda J, Christie of record in Deed Book 1090 at Page 516. This information is true to the best of my knowledge and is subject to any and all exceptions, restrictions, covenants, and right of ways set forth in deeds of record.
Being the same property conveyed to Tara L Marks and William T Yates III by the Deed dated May 17, 2010 and recorded in Deed Book 1155 at Page 340 in the Office of the Clerk of the County Commission of Wood County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
