NOTICE OF TRUSTEEáS SALE

 

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 2, 2006, executed by Borrower(s), Patty D Bunner, to William T. Nestor, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1394, at Page 526. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 7, 2017, of record in the Clerk’s Office in Book 2000, Page 571. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust.  Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

9th day of March, 2018 at 12:00 p.m.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Clay District, Wood County, West Virginia, and being more particularly described as follows:

 

All of that certain lot, tract or parcel of land lying and being situate in the District of Clay, County of Wood, State of West Virginia, more particularly bounded and described as follows:

 

Beginning at an iron rod (found), the northerly common corner of the parent property (Second Tract, Deed Book 908, Page 311) and B. J. Kuhl (Deed Book 498, Page 437); thence with the northerly line of the parent property, N 81õ 16’ 07ã E 208.60 feet to a pipe (found); thence with the easterly line of the parent property, S 08õ 23’ 54ã E 265.90 feet to an iron rod (set); thence with the interior of the parent property, S 81õ 16’ 07ã W 208.57 feet to an iron rod (set); thence with the westerly line of the parent property, the easterly line of said B. J. Kuhl, N 08õ 24’ 17ã W 265.90 feet to the point of beginning, and containing 1.273 acres, more or less, all as more particularly shown on that certain Boundary Survey dated October 12, 2006 by James L. DeBrular, P.S. No. 238, said Survey attached hereto for a more particular description of said property.

 

Together with that certain 16 foot wide easement for ingress and egress to the property hereby conveyed, said easement being described as follows:

 

Beginning at a point in the northerly right of way line of West Virginia State Route 47 (State Project #3506), where an iron pipe (found) bears S 82õ 05’ 20ã W 12.68 feet, said iron pipe being the southwesterly corner of John and Bonnie Longfellow (Section Tract, Deed Book 908, Page 311); thence with the interior of the parent property (Section Tract, Deed Book 908, Page 311), the center of an existing drive, the centerline of the herein described 16 feet wide easement, six (6) courses: N 11õ 38’ 28ã E 45.40 feet; N 01õ 41’ 28ã E 64.00 feet; N 12õ 40’ 37ã W 46.97 feet; N 17õ 51’ 13ã W 61.89 feet; N 09õ 38’ 41ã W 128.73 feet; N 01õ 25’ 19ã W 16.50 feet to the southerly line of a 1.273 acres tract, northerly terminus of the herein described 16 feet wide easement, all as more particularly shown on that certain Boundary Survey dated October 12, 2006 by James L. DeBrular, P.S. No. 238, said Survey attached hereto for amore particular description of the easement herein conveyed.

 

Being part of the same property (Second Tract) conveyed to John and Bonne Longfellow by deed dated June 18, 1992, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 908, at page 311. And being the same property conveyed unto Patty Darlene Bunner by deed dated the 2nd day of November, 2006 to be recorded immediately prior hereto.

 

Subject to all rights of way, reservations, restrictive and protective covenants, agreements, utility easements and oil, gas and mineral leases of record in the chain of title.

 

This included the Water Discharge Agreement of May 11, 1995, recorded in Book 943 at Page 205, being the easement for the discharge of the treated water from a septic system located upon a tract of land containing 7500 square feet, more or less, said tract of land recorded in Deed Book 908 at Page 311 and being the same tract of land referred to herein.

 

Being the same property conveyed to Patty D Bunner by the Deed dated November 2, 2006 and recorded in Deed Book 1105 at Page 304 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
