Pursuant to the authority vested in the undersigned Trustee, by a Deed of Trust dated the 20th day of May, 2016, executed by Melvin L. Romeo, to Craig J. Wakefield, Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book No. 1920, at Page 750.

Melvin L. Romeo has defaulted under the terms of the Promissory Note secured by the Deed of Trust. The debt evidenced by the Promissory Note has therefore been accelerated by the lender, Christine E. Bender.

At the request of the beneficiary, holder, and owner of the Deed of Trust, the undersigned Trustee, through her agent, will sell at public auction to the highest bidder at 1:00 p.m. , on the 21st day of April, 2017, on the steps of the Wood County Courthouse in Parkersburg, West Virginia, the following described real estate:

All that certain lot, tract or parcel of real estate located in the City of Parkersburg, County of Wood and State of West Virginia, more particularly bounded and described as follows:


FIRST TRACT: BEING part of In Lot No. 92 and beginning on Phillips Court Alley fifty feet in a southwesterly direction from Fifth Street (formerly Littleton Street) and running with said Phillips Court Alley, still in a southwesterly direction, thirty-five feet and parallel with Market Street; thence at right angles and parallel with Fifth Street forty feet; thence at right angles and parallel with Phillips Court Alley, thirty-five feet; thence at right angles and parallel with Fifth Street, forty feet to the beginning.


SECOND TRACT: ALSO, another part of said In Lot No. 92 and bounded as follows:


BEGINNING at the junction of Phillips Court Alley and Fifth Street, thence down said 5th Street toward the Ohio River and parallel with said street, forty feet; thence toward the Little Kanawha River and parallel with Market Street, 50 feet; thence a straight line forty feet to said Phillips Court Alley and thence with the line of said alley 50 feet to the place of beginning.


This conveyance is made subject to any and all reservations, covenants, restrictions and easements as the same may appear in instruments of record in the aforesaid Clerkás Office.


Being the same premises as conveyed by Deed from to Christine E. Bender to Melvin L. Rome, dated May 23, 2016, as recorded in Deed Book 1248, Page 240, Office of the Clerk of the County Commission of Wood County, West Virginia.


The above-described property is reported to have a mailing address of or is commonly known as: 316 5th Street, Parkersburg, WV 26101.

The real estate will be sold subject to real estate taxes assessed against the real estate, zoning regulations, prior Deeds of Trust, judgment liens, leases, including, but not limited to, oil, gas, and mineral leases, restrictions, rights-of-way, reservations, protective covenants, delinquent fees, rates and charges of any public service district, recorded or unrecorded, public utility easements and easements of record affecting the real estate.

The property is sold subject to those facts which might be disclosed by visual examination, survey, title examination or environmental audit.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

TERMS OF SALE: Cash in hand on day of sale or 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down on the day of sale and full payment within 14 days of the date of sale. Failure to tender the remaining balance of the purchase price to the Trustees within 14 days shall constitute a forfeiture of the buyer’s bid as if it were null and void and said purchaser’s down payment shall be forfeited to the Trustees for costs of sale. The Trustees does not want title to this property.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance, please contact the undersigned. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee.
