NOTICE OF TRUSTEE’S SALE

 

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated November 30, 2005, executed by Borrowers Jennifer L. Brown and Tab A. Brown, to Golden and Amos, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1328, at Page 669. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 548 Marrtown Road, Parkersburg, WV 26101. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 12, 2015, of record in the Clerkás Office in Book 1855, Page 483. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

March 5, 2015 at 5:57 p.m.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and being more particularly described as follows:

 

Located in the District of Lubeck, County of Wood and State of West Virginia, to-wit:

 

PARCEL ONE:

FIRST TRACT:

 

BEGINNING at the corner of Harriet Kidd lot; thence running west 100 feet to the corner of Harriet Kidd lot; thence north 30 feet to corner of Dale Sager lot; thence east 100 feet to corner of Dale Sager lot; thence south 30 feet to the place of beginning; this lot being 30 X.100 feet less ten feet off back end for ten foot alley to be left as private alley for all the lots, to the place of beginning.

 

SECOND TRACT:

 

BEGINNING at the corner of Dixie Sams lot running with said land west 100 feet to corner of Dixie Sams lots; thence north 30 feet; thence east 100 feet to the Washington Bottom Road; thence south 30 feet to the place of beginning, this lot being 30 X 100 feet less ten foot alley on back end to the left as private alley for all the lots.

 

THIRD TRACT:

 

BEGINNING at a corner of Joseph E. Sager lot and running thence with said Sager line and the Lubeck and Washington Bottom Road in a northerly direction 40 feet; thence in a westerly direction 100 feet; thence in a southerly direction 40 feet to Joseph E. Sager lot; thence with said Sager line in an easterly line 100 feet to the place of beginning.

 

PARCEL TWO:

 

BEGINNING at the forks of the Washington Bottom Road and Lubeck Road, at Marrtown; thence with the said Washington Bottom Road towards Washington Bottom in a westerly direction 96 feet; thence in a northerly direction 50 feet; thence in an easterly direction 96 feet to the public road; thence 50 feet to the place of beginning.

 

 

Being the same property conveyed to Jennifer L. Brown and Tab A. Brown by the Deed dated November 30, 2005 and recorded in Deed Book 1090 at Page 463 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

 

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

 

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale by certified or cashier’s check.
