NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 30, 2009, executed by Borrower(s), Anita A Hanifan and Deborah A Wright, to Great American Title , the Trustee of record in the office of the Clerk of the County Commission of Randolph County, West Virginia, in Book 454, at Page 365. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 440 Wilson Street, Elkins, WV 26241. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 16, 2015, of record in the Clerk’s Office in Book 542, Page 530. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Randolph County, in Elkins, West Virginia, on the following date:

March 23rd, 2016, at 4:30 P.M.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Elkins Corp. District, Randolph County, West Virginia, and being more particularly described as follows:

All of that lot or parcel of land designated as Parcel “B” of the Lunsford Holland Wilson Street division, situate on Wilson Street, in Elkins, West Virginia, on the north side of thereof, about 0.2 miles southeast of the Elkins Junior High School, in Elkins Corporation District, Randolph County, West Virginia, and more particularly described as follows:

Beginning at a point in the northern boundary of said Wilson Street (Width = 60 Ft.), being the southeast corner of Lot No. 119 and being in the southeast corner of Lot No. 119 and being in the eastern boundary of the Yokum and Hinkle Addition, a corner to Lot No. 9 of the Robert Hedrick Division of the Annie Levier Property (DB 147/242), now Dennis Ray Law (WB 30/563 – Ref. – DB 389/522), set a 3/4 x 30’ rebar with alum. cap from which a 7” square stone marker with a cross, found, bears S 29∂ 36’ W, 390.14 feet and a power pole bears S 18∂ 20’ W, 10.4 feet; thence with the northern boundary of said Wilson Street N 60∂ 03’ W, 98.00 feet to a point in the northern boundary of said Street, a corner to Parcel “A” of said Holland division, set a “A” x 30” rebar with alum. cap, from which Southwest corner of the house bears N 71∂ 00’ E, 41.80 feet; thence through Lot No. 121 and with Parcel “A” of said Holland division

N 31∂ 43’ E, 142.14 feet to a point in the southern boundary of a 16 foot alley, a corner to said Parcel “A”, set a 3/4 x 42” rebar with alum. cap, from which a point at the corner of Lot No. 121 and 122 (Deschenes – DB 379/460), bears N 60∂ 03’ W, 22.40 feet; thence with the southern boundary of said 16 foot alley

S 60∂ 03’ E, 92.75 feet to a point at the corner of said alley, being in the eastern boundary of said Yokum and Hinkle Addition, a corner to said Dennis Law, set at 3/4” x 42” rebar with alum, cap, from which a 3/4” rebar with alum. cap in concrete, a corner to my survey of Hinkle Properties (DB 398/741), bears N. 29∂ 36’ E, 344.66 feet; thence with Dennis Law

S 29∂ 36’ W, 142.07 feet to the beginning, containing 13,549.7 square feet, or 0.31 Acres more or less, all bearings being “1991” magnetic north, as surveyed in September, 1993, by Leon G. Mallow, WV, and as shown on a Plat attached to that deed from Holland to Emme, dated September 30, 1993, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 428, at Page 714.

Being the same property conveyed to Anita A Hanifan and Deborah A Wright by the Deed dated March 30, 2009 and recorded in Deed Book 532 at Page 476 in the Office of the Clerk of the County Commission of Randolph County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code section 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
