The object of the above styled civil action is to partition certain real property situate at 7207 Lost Pavement Road, in the Township of Washington, District of Tygart, County of Wood and State of West Virginia, which real property is more particularly described as:

 

TRACT ONE: BEGINNING at a stone on the north side of a corner to A. Wile, with Wile N. 16 degrees 02á W. 157.2 poles to a stone, a corner to wile; thence N. 82 degrees 44á W. 19.5 poles to a Black Oak, corner to John Wermlinger; thence N. 43 degrees 18á E. 22.72 poles to a stone, on the west side of the road; thence N. 15 degrees 54á W. 43.72 poles to a stake, corner of Wermlinger; thence through the tract of which this is a part S. 64 degrees E. 117.5 poles to a stone, a corner to William Weaver; thence with his line S. 16 degrees 02á E. 106.78 poles to a stone pile, a corner to H. Cochran; thence with Cochran S. 52 degrees 27á W. 96.32 poles to the place of beginning, containing ninety (90) acres, more or less.

 

TRACT TWO: – PARCEL ONE: BEGINNING at a stone in the line of M. F. Guinn and running with said line S. 30 E. 21 poles to a white oak stump near an old log stable; thence S. 21-1/2 W. 33 poles to a white oak, corner to M. F. Guinn in Spriggins line; thence with said Spriggins line N. 69-1/2 E. 131 poles to a black oak and chestnut pointers; thence N. 16 W. 2 poles to a stake, corner to Fred Fankhauser; thence with said Fankhauser line N. 81-1/2 W. 33 poles to a white oak; thence N. 22-1/2 W. 41 poles to a pine stump; thence N. 23-1/2 W. 6 poles to a stone corner in said line; thence S. 55 W. 84 poles to the place of beginning, containing 26 acres and 124 poles, more or less.

Parcel One is subject to the following out conveyances:

  1. One acre by deed recorded in Deed Book 455,at page 367;
  2. Two acres by deed recorded in Deed Book 287, at page 255; and,
  3. Two acres by deed recorded in Deed Book 432, at page 56.

PARCEL TWO: BEGINNING a stake, the southwest corner of the above described tract, corner to Frank Guinn; thence with said Guinn line N. 71 degrees 36á E. 127.8 poles to a stone pile with C. 0. pointers; thence with a line of Wm. Weaver S. 12 degrees 30á E. 70.8 poles to a stone, a corner of said Weaver; thence with another line of said Weaver S. 52 degrees 38á W. 39.48 poles to a stone, corner to Clarence Guinn; thence with a line of said Clarence Guinn N. 64 W. 117.5 poles to the place of beginning, containing 41 acres 151 poles, more or less.

This conveyance is made subject to the following out conveyances:

  1. 46 acres by deed recorded in deed book 583, at page 307;
  2. 1.753 acres (including road) by deed recorded in Deed Book at 639, page 50; and,
  3. 15.49 acres (including road), by deed recorded in Deed Book 925, at page 612.

 

It appearing by Affidavit filed in this action that the Defendants, David Dornon and Kathy Flowers, are non-residents of the State of West Virginia, and she is advised that last known address for such Defendants are as follows:

It is ORDERED that David Dornon, Kathy Flowers, Anna Mae Rogers McQuaid, Shannon Dornon, James Edward Eric Dornon, Sharon Ruth Dornon, and Clarence Bryon Dornon, appear and serve upon Robert S. Fluharty Jr., attorney for the Plaintiff, whose address is 417 Grand Park Drive, Suite 101, Parkersburg, West Virginia 26105, an Answer, including any related counterclaim or defense they may have to the Complaint filed in this action, on or before the 30th day of May, 2018. If you fail to do so, thereafter judgment, upon proper hearing and trial, may be taken against you for the relief demanded in the Complaint.

A copy of said complaint can be obtained from the undersigned Clerk at this office located in the Wood County Courthouse situate in Parkersburg, Wood County, West Virginia.
