ORDER OF PUBLICATION The object of the above entitled action is to seek a Declaratory Judgment stating that the applicable lien contract, or deed of trust, covering the Real Property and affixed mobile home was executed in accordance with the applicable provisions of the laws of the State of West Virginia, the state in which the lien originated, in order to allow Plaintiff to cancel the mobile home certificate of title with the Department of Motor Vehicles, relating to the Deed of Trust recorded in Fayette County, West Virginia, in Trust Deed Book 816, at page 698. And it appearing by that the identity and whereabouts of Defendant, Michael J. Mavin, is unknown and cannot be located after due diligence, it is ORDERED that the above named Defendant serve upon Plaintiff’s attorney W. Scott Campbell and Patrick D. Johnson, of the law firm of Samuel I. White, P.C., whose mailing address is 601 Morris Street, Suite 400, Charleston, WV 25301, an Answer or any defense to the Complaint filed in this action, on or before February 10, 2015; otherwise judgment by default may be taken against said Defendant at any time thereafter.
