Crouch, Scott E. Hartzog and Donna Kay Hoy, his wife, Kenneth M. Hartzog and Mary Hartzog, his wife, Judith H. Miles, single, and I. Jean Eshelman, single, Defendants. ORDER OF PUBLICATION To the above named defendants who are non-residents of the State of West Virginia and who owned a fractional share of real estate commonly known as “Crouch’s Farm” located in Oceana District, Wyoming County, West Virginia, on July 15, 2015 when water run off from gas well sites operated by Exco Resources, LLC. It is hereby ORDERED that Scott E. Hartzog, Donna Kay Hoy, Kenneth M. Hartzog, Mary Hartzog, Judith H. Miles and I. Jean Eshelman, serve upon John S. Hrko, Plaintiff’s Attorney, whose address is 103 Guyandotte Avenue, Mullens, WV 25882, an answer including any related counterclaim or defense they may have to the Complaint filed in this action on or before the 17th day of August, 2016. In the event they fail to do so, thereafter judgment upon proper hearing and/or trial, may be taken against them for the relief demanded in the Complaint. The object of this legal action is to obtain a money judgment for damages resulting from the damages done to plaintiff’s real estate, prejudgment interest, post judgment interest, costs, expenses and other relief which the Court may deem proper.
