ORDINANCE NUMBER 105.11 OF THE CITY OF MULLENS
AN ORDINANCE AMENDING ORDINANCE NUMBER 105.08 AND THE CHARTER OF THE
CITY OF MULLENS TO CHANGE THE METHOD OF NOMINATING CANDIDATES
DESIRING TO RUN FOR OFFICE TO BECOME CITY OFFICIALS.

WHEREAS, The Charter of the City of Mullens provides that candidates for elective offices shall be nominated by members of the respective political parties assembled in convention.

WHEREAS, The West Virginia Secretary of State's office has indicated that this method of placing candidates on a general election ballot is out dated, as only a few municipalities continue to use this method, and this system is easily susceptible to error and fraud.

WHEREAS, The City Commission now believes that the current method of being placed on the general election ballot needs to be replaced with a method that is more open and fair to the residence of the City of Mullens.

NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE COMMISSION OF THE CITY OF MULLENS, AS FOLLOWS:

ARTICLE-FINDINGS: The Commission of the City of Mullens hereby makes the following findings:

(1)Pursuant to Ordinance number 105.08 the City Commission established a method of nominating candidates of elected officials in the City of Mullens through political parties.
(2)The West Virginia Secretary of States office has indicated that is an outdated method susceptible to error and fraud.
(3)The City Commission hereby establishes that individuals to be nominated for placement on the general election ballot do so in accordance with rules that the West Virginia Secretary of States office has developed for municipalities.
(4)Ordinance number 105.08 be eliminate and replaced with Ordinance number 105.11.

ARTICLE II-EFFECTIVE DATE: This Ordinance shall be deemed effective thirty (30) days following the second (2nd) reading, passage and adoption by the Commission of the City of Mullens.i.e. January 10, 2026.
