NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Credit Line Deed of Trust dated August 17, 2012, executed by Thomas A. Parnell to Robert D. Lewis, Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1238, at Page 247. Bailey & Slotnick, PLLC was appointed as Trustee by SUBSTITUTION OF TRUSTEE dated May 7, 2019, of record in the Clerk’s Office in Book 1372, at Page 475. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the side door of the Courthouse of Mercer County, in Princeton, West Virginia, on:

THURSDAY, OCTOBER 3, 2019, AT 1:15 O’CLOCK P.M.

All those certain lots, tracts or parcels of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate Princeton District, Mercer County, West Virginia, and being more particularly bounded and described as follows:

Tract 1: The following described real estate, together with the improvements thereon and the appurtenances thereon belonging, which real estate is situated on the north side of Princeton Avenue in what is known as the Sentz Addition to the City of Princeton, within Mercer County, West Virginia which consists of a part of Lot No. 6 of said addition and is bounded and described as follows: BEGINNING at a point in the northerly line of Princeton Avenue which stands 90 feet in an easterly direction from the northeast corner of the intersection of Fellers Street and Princeton Avenue, which point, as well is 21.8 feet from the southeast corner of Lot No. 5 of said addition; thence, paralleling the division line between said Lot No. 6 and Lot No. 5 of said addition in a northerly direction 142.5 feet to an alley; thence, with the southerly line of said alley and in an easterly direction 43.2 feet to the northeast corner of Lot No. 6; thence with the easterly line of Lot No. 6 142.5 feet (the property of Steven Hassen, this day conveyed unto the said Steven Hassen by party of the first part hereof) to the northerly line of Princeton Avenue; thence, with the northerly line of Princeton Avenue in a westerly direction 43.2 fee to the point of BEGINNING and being a part of Lot No. 6 of said addition.

Tract 2: All that certain strip or parcel of land off of the rear of Lots 5 and 6 of the Sentz Addition to the City of Princeton, Mercer County, West Virginia, facing the south line of a 15 feet wide alley beginning at the point of intersection of the south line of said alley with the east line of Fellers Street; thence along the south line of said alley 89,5 feet to a point; thence south between parallel lines, 4.5 feet, being a strip 4.5 feet by 89.5 feet off of the property conveyed to Sam Hassen by Kathleen Karnes by deed dated August 7, 1945, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 273, at page 529,conveyed under the terms of the Will of am Hassen probated in said Clerk’s Office on March 23, 1989, and recorded in Will Book 48 at page 455, unto Steven Hassen by Isabel Boggs, Executrix by deed dated May 17, 1989, of record in said Clerk’s Office in Deed Book 689, at page 325.

This is the same property conveyed unto Thomas A. Parnell by deed dated August 6, 2012, of record in the Clerk’s Office in Deed Book 979, at Page 143.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or money order at the time and place of the sale. There will be no refund granted of any amount if the third party purchaser elects not to purchase the property for any reason. Minimum acceptable bid will be $59,304.00.
