PRE-ADOPTION NEWSPAPER NOTICE FOR SEWER RATE CHANGES
NOTICE OF PUBLIC HEARING
CITY OF PARSONS, TUCKER COUNTY, WEST VIRGINIA
SEWAGE SERVICE CUSTOMER
Notice is hereby given that the City of Parsons, Tucker County, West Virginia, a municipal corporation, will hold a hearing before the final vote on a proposed Ordinance, the principal object of which is the increase of sewage rates for customers of the sewerage system operated by the City of Parsons, Tucker
County, West Virginia.
The City of Parsons, Tucker County, West Virginia is proposing the following Ordinance:

AN ORDINANCE SETTING FORTH THE RATES, FEES, AND
CHARGES FOR SERVICE TO CUSTOMERS OF THE SEWERAGE
SYSTEM OF THE CITY OF PARSONS.
THE COUNCIL OF THE CITY OF PARSONS HEREBY ORDAINS:
The following rules, rates, and charges are hereby fixed, determined, and established for municipal
sewage service provided to all users of the City of Parsons Municipal Sewage Treatment Plant and
Collection System, commencing upon the effective date as hereinafter provided, and in accordance
with the following rates and schedules:
RULES AND REGULATIONS
Rules and Regulations for the Government of Sewer Utilities, adopted by the Public Service
Commission of West Virginia, and now in effect, and all amendments thereto and modifications
thereof hereafter made by said Commission.
SECTION 1 – SEWER TARIFF
APPLICABILITY
Applicable within the entire territory served.
AVAILABILITY OF SERVICE
Available for general domestic, commercial, industrial, and sale for resale sewage service.
RATES
First 5,000 gallons used per month $ 13.43 per 1,000 gallons
Next 15,000 gallons used per month $ 7.14 per 1,000 gallons
All over 20,000 gallons used per month $ 4.31 per 1,000 gallons
MINIMUM CHARGE
No bill will be rendered for less than $26.86 per month.
SALES FOR RESALE SERVICE
All sewage from Hamrick Public Service District will be treated at the approved rate of $2.25 per
1,000 gallons of water consumed.
DELAYED PAYMENT PENALTY
The above schedule is net. On all accounts not paid in full when due, ten percent (10%) will be
added to the net current amount unpaid. This delayed payment penalty is not interest and is to be
collected only once for each bill where it is applicable.
SECURITY DEPOSIT
An initial security deposit for new service will be required equal to one-twelfth (1/12) of the
annual estimated charge for residential service (based on 4,000 gallons or $53.72) or one-sixth
(1/6) of the annual estimated charge for all other service.
TAP FEE
The following charge is to be made whenever the utility installs a new tap to serve an applicant.
A tap fee of $400.00 will be charged to all customers who apply for service outside of a
certificate proceeding before the Commission for each new tap to the system.
DISCONNECTION
If any bill is not paid within thirty (30) days after the date of the mailing thereof, water and
sewage service to the customer will be discontinued, provided, however, that at least three (3)
days before the discontinuation of sewage service, a notice of such discontinuation shall be mailed
to the delinquent customer at his last address on record with the Billing Clerk, by regular United
States Mail, postage prepaid. Water and sewage service will not be restored until all past due
sewage bills have been paid in full and all accrued penalties plus a reconnection charge of
Twenty-Five Dollars ($25.00) shall be paid.
RETURN CHECK CHARGE
A service charge equal to the actual bank fee assessed to the City or a maximum of $25.00 will
be imposed upon any customer whose check for payment of charges is returned by their bank due
to insufficient funds or any other reason.
ADJUSTMENT FOR UNUSUAL CONSUMPTION
When the City of Parsons determines that there has been unusual consumption of sewage
treatment services by any customer which can be attributed by the City of Parsons to be eligible
leakage of water on the customer’s side of the water meter, the City of Parsons shall assess and
bill, and the customer shall pay, to the sewer fund of the City of Parsons a sewage treatment charge
of One Dollar and Thirty Two Cents ($1.32) per thousand gallons of water (or fraction thereof)
over and above the customer’s two-year historical average usage of water.
SURFACE OR GROUNDWATER SURCHARGE
An additional amount shall be charged where surface or groundwater is introduced into the
sanitary sewerage system where evidence of a violation exists.
Surcharge formula to be applied in case where surface drainage is connected to the utility’s
sewerage system.
Applicability
Whenever the utility has discovered that a customer’s roof drain, downspout, storm sewer or
similar facilities conducting surface water have been connected to the utility’s sewerage system,
and such customer has failed to take appropriate action within sixty (60) days of receipt of a
demand by the utility, in accordance with the Rules of Public Service Commission, to eliminate
such connection, a surcharge will be imposed upon the customer calculated on the basis of the
following formula:
S=A x Rx 0.0006233 x C
S = The surcharge in dollars.
A = The area under roof and/or the area of any other water collection surface
connected to the sanitary sewer, in square feet.
R = The measured monthly rainfall, in inches.
.0006233 = A conversion factor to change inches of rain X square feet of surface water
to thousands of gallons of water.
.0008333 = A conversion factor to change inches of rain X square feet of surface water to
thousands of gallons of water.
C = The utility’s approved rate per thousand gallons of metered water usage.
The utility shall not impose the surcharge unless and until the customer has been notified by
certified mail, return receipt requested, or by hand delivery, that it has been established by smoke
testing, dye testing, or on-site inspection that rain or surface water is being introduced into the
sanitary sewerage system at the customer’s location, and that the customer has not acted within
sixty (60) days from receipt of such notice to divert the water from the sanitary sewerage system.
Said surcharge shall be calculated and imposed for each month that said condition continues to
exist. Failure to pay the surcharge and/ or correct the situation shall give rise to the possible
termination of water service in accordance with the Rules of the Public Service Commission of
West Virginia.
SECTION 2 – EFFECTIVE DATE
The rates, charges, and penalties provided herein shall become effective forty-five (45) days from
the date of passage as provided herein, or as soon thereafter as the same may be approved by the
Public Service Commission of West Virginia.
SECTION 3 – SEVERABILITY: REPEAL OF CONFLICTING ORDINANCES
The provisions of this Ordinance are severable, and if any clause, provision or section hereof shall
be held void or unenforceable by the Public Service Commission of West Virginia or any
court of competent jurisdiction, such holding shall not affect the remainder of this Ordinance.
Upon the effective date hereof, all ordinances, resolutions, orders or parts thereof in conflict with
the provisions of this Ordinance are, to the extent of such conflicts, hereby repealed, and to the
extent that the provisions of this Ordinance do not touch upon the provisions of prior
ordinances, resolutions, orders or parts thereof, the same shall remain in full force and effect.

The final vote on adoption of said Ordinance shall be held in the Council Chambers of the Charles W. “Bill” Rosenau Municipal Building, 341 Second Street, Parsons, Tucker County, West Virginia on Tuesday, March 16, 2021, at six o’clock (6:00) P.M. (EST). Interested parties may appear and be heard at such time with respect to the passage of the proposed Ordinance. Copies of said Ordinance are available at the City of Parsons Business Office, located at 341 Second Street, Parsons, West Virginia, between 8:00 A.M. and 5:00 P.M. (EST), Monday through Friday, except holidays. The said Ordinance may be materially amended at said meeting.
If adopted, said rates, fees, and charges will become effective forty-five (45) days from the date of its passage, unless otherwise ordered by the Public Service Commission of West Virginia.
