CANAAN VALLEY PUBLIC SERVICE DISTRICT
Application for a Certificate of Convenience and Necessity to construct an expansion project to
provide sewage treatment service to new customers to be treated at the Zone D Plant (including
additional lines, lift stations, pumps and related apparatus) along Appalachian Highway
(W. Va. State Rt. 32), Bensland Road, Cortland Road, and Maple Grove Road in Canaan Valley,
near Davis, Tucker County, West Virginia.
REVISED NOTICE OF FILING
On August 3, 2023, the Canaan Valley Public Service District (CVPSD) filed an application, duly verified, for a Certificate to construct certain additions and improvements to the Zone D wastewater transmission and treatment system in Tucker County. CVPSD seeks in this proceeding (1) to obtain a certificate of convenience and necessity to expand its service in Zone D to serve additional resale, commercial and residential customers and users and (2) to the extent necessary, to seek approval of a new tariff (a) to cover any projected increase in its operational and maintenance costs for its entire system and customer base, and (b) to cover the costs not covered by grants and interest free loans which will be reasonably incurred to make the improvements requested in this application for a certificate of convenience and necessity. The proposed project will serve customers along Appalachian Highway (W.Va. State Rt. 32), Bensland Road, Cortland Road, and Maple Grove Road in Canaan Valley, near Davis, Tucker County, West Virginia.
On October 18, 2023, the District filed a revised application.
The revised application is on file with and available for public inspection at the Public Service Commission, at 201 Brooks Street, in Charleston, West Virginia.
The Canaan Valley Public Service District estimates that construction will cost approximately $3,405,000.00. It is proposed that the construction will be financed as follows: A debt forgiveness loan from the West Virginia Department of Environmental Protection (WVDEP) in the amount of $1,500,000; a $500,000.00 grant from the West Virginia Infrastructure and Jobs Development Council (WVIJDC); and a loan from the WVDEP of $1,405,000.00 with a term of 40 years, with an annual interest rate of 0.25% and an annual administrative fee of 0.25%.
The utility anticipates charging the following sewer rates and including the following tariff language for its customers:
APPLICABILITY:
Applicable within the entire area served.
AVAILABILITY:
Available for General Residential, Commercial, Industrial, and Sale to Resale Customers.
MINIMUM MONTHLY CHARGE:
$86.00 per Equivalent Dwelling Unit (EDU)1
DELAYED PAYMENT PENALTY:
The above schedule is net. On all accounts not paid in full within thirty (30) days of the date of the bill,
ten percent (10%) will be added to the net current amount unpaid. This delayed payment penalty is not
interest and is to be collected only once for each bill where it is appropriate.
TAP FEE:
The following charges are to be made whenever the Utility installs a new tap to serve an applicant:
A tap fee of $300.00 will be charged to customers applying for service before construction is completed
adjacent to the customer’s premises in connection with a certificate proceeding before the Commission.
This pre-construction tap fee will be invalid after the completion of construction adjacent to an
applicant’s premises that is associated with a certificate proceeding.
A tap fee of $300.00 will be charged to all customers applying for service outside of a certificate
proceeding before the Commission for each new tap to the system.
8.97% CASH WORKING CAPITAL RESERVE INCREMENT:
8.97% of total billings at the indicated rates is required to be recorded as a credit to “Miscellaneous
Operating Reserves”, with related collections to be charged to “Other Special Funds” and deposited into
a distinct CWCR Bank Account.

BILLING:
Whenever sewage treatment is disconnected or stopped at a customer’s request, and a request for
reinstatement of sewage treatment service to the same premises is made by the customer of record or any
adult member of that customer’s household in the next succeeding twelve months, the customer shall pay
a reconnection fee of $100.00 and an additional sum equal to the minimum charge per each billing
month, or portion thereof, for the period of time that service was disconnected.
These rates represent no project-related rate increase. Language changes are to become effective upon
substantial completion of the project unless otherwise ordered.
NOTE: Because CVPSD does not meter the sewage collected from each customer, all customers and resale customers within Zone D are invoiced for one Equivalent Dwelling Unit (1 EDU) (280 gallons per day) or a smaller percentage of one EDU in some instances. The WVPSC has approved billing by EDU by the Canaan Valley Public Service District.
These rates represent no project-related rate increases to become effective upon substantial completion of the project.

Current resale customers of Canaan Valley Public Service District in Zone D include Black Bear Woods Resort Owners Association, Beaver Ridge Resort Owners Association, North Point Owners Association, and Northlake Owners Association. The resale customers to be added in the proposed expansion project include Deerfield Village Owners Association, Inc., and Windwood Water Works, LLC.
The proposed rates and charges among the various classes of customers are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing.
Anyone desiring to protest or intervene should file a written protest or request to intervene within thirty (30) days following the date of this publication unless otherwise modified by Commission order. Failure to timely protest or request to intervene can affect your right to protest aspects of this certificate case, including any associated rate increases, or to participate in future proceedings. All protests or requests to intervene should briefly state the reason for the protest or request to intervene. Requests to intervene must comply with the rules on intervention set forth in the Commission’s Rules of Practice and Procedure. In the absence of substantial protest received within thirty (30) days of this publication, the Commission may waive formal hearing and grant the application based on the Commission’s review of the evidence submitted with the application.
