General Investigation of TFSU financing agreements.
NOTICE OF INVESTIGATION
By Order issued December 17, 2021, the Public Service Commission of West Virginia initiated an investigation of a financing agreement between Timberline Four Seasons Utilities, Inc. (TFSU) and Kapitus Servicing, Inc. (Kapitus) to determine whether the agreement adversely affect the interests of the public in this state. The Commission also required TFSU to advise the Commission of any other financing arrangements involving the transfer or assignment of TFSU’s assets that TFSU entered into without the prior consent and approval of the Commission.
On January 18, 2022, TFSU reported to the Commission that it had similar contracts with DNRA, LLC, dba The Smarter Merchant, LLC and with Quarterspot, Inc. Neither of these contracts were submitted to the Public Service Commission for review as required by W.Va. Code §24-2-12 before they were entered into.
The Commission will review whether these contracts are void as being contrary to the public interest.
Anyone desiring to intervene and act as a party in this case should file a petition to intervene within ten days of this publication, complying with the rules on intervention set forth in the Commission’s Rules of Practice and Procedure. Anyone desiring to file a written comment should do so as soon as possible although comments will be accepted throughout the pendency of this proceeding.
