PUBLIC HEARING

Public hearing for the following Ordinance will be held during the special meeting of Common Council on Tuesday, July 28, 2015 at 6:30 p.m., in Council Chambers of Beckley City Hall. All interested parties are urged to attend. AN ORDINANCE AUTHORIZING THE CITY OF BECKLEY TO PURCHASE ONE (1) PARCEL OF REAL ESTATE IN THE CITY OF BECKLEY IDENTIFIED AS LOT 232 OF THE BECKLEY COURT EXTENSION, BECKLEY CORPORATION DISTRICT 01, MAP NO. 86, PARCEL 86 WHEREAS, the City of Beckley is desirous of purchasing a parcel of real estate located on Ridgecrest Avenue in Beckley, Raleigh County, West Virginia; and WHEREAS, the owners, J.W Walters, J.W. Word, Jr., S.J. Word and H.B. Walters, dba J.W.W. Company, and their successors has offered to convey this lot to the City of Beckley for the sum of Two Hundred Dollars ($200.00); and WHEREAS, the City of Beckley is purchasing this property at the request of the Beckley Sanitary Board as part of the Red Brush Sewer Improvement Project; and WHEREAS, the Beckley Sanitary Board, at its July 8, 2015 meeting adopted a Resolution requesting the City of Beckley to purchase this lot. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF BECKLEY: That the City of Beckley, for the benefit of the Beckley Sanitary Board, purchase from J.W. Walters, J.W. Word, Jr., S.J. Word and H.B. Walters, dba J.W.W. Company, and their successors for the sum of Two Hundred Dollars ($200.00) the parcel of real estate located on Ridgecrest Avenue in Beckley, Raleigh County, West Virginia, and more particularly identified as Lot No. 232 of the Beckley Court Extension, Beckley Corporation, District 01, Map No. 86, Parcel 86 as shown on the attached Exhibit. The Mayor of the City of Beckley is hereby authorized to execute any and all documents required to facilitate this purchase. This Ordinance shall become effective upon passage. Exhibit “A” DESCRIPTION OF THREE (3) PARCELS OF REAL ESTATE TO BE PURCHASED BY THE CITY OF BECKLEY FROM GLORIA JEAN CLAYTOR ROGERS PARCEL I: Part Lot 95 Sprague Subdivision Map/Parcel: 1001/166 District: Town BEGINNING at the intersection point of the respective southeast and southwest property lines of WEST FIRST STREET and SHORT STREET; thence with the southwesterly side of Short Street by two calls as follows: S 32 f 28′ W 87.91 feet to a stake; thence S 29 f 32′ W 25.10 feet to a stake at the northwesterly corner of the end of a Ewart Heights Subdivision street on the common boundary line between said Subdivision and the party of the first part; thence with said common boundary line N 82 f 14′ W 43.06 feet to a stake; thence leaving said Subdivision line N 32 f 28′ W 71.90 feet to a stake on the southeasterly side of said West First Street; thence with the line of said street N 57 f 32′ E 55.00 feet to the beginning, being the northeasterly portion of Sprague Lot 95 and containing 0.11 acre, more or less, around Sprague House No. 95, the described lot being more fully shown on a blueprint map entitled “MAP SHOWING SURFACE LOT AT SPRAGUE, WEST VIRGINIA, TO BE DEEDED BY LOUP CREEK REALTY, INC. PARCEL III: Sur Part Lot 19 Sec 7A Ewart Hgts Add Map/Parcel: 5/141.1 District: Beckley The surface of Lot No. 19 of Section No. 7A of Ewart Heights Addition, City of Beckley, Raleigh County, West Virginia, as shown upon a map of said Ewart Heights Addition of record in said Clerk’s Office in Deed Book No. 215, at page 55. EXCEPTING AND RESERVING that portion of Lot No. 19 which was conveyed from I. W. Drake and Ellen B.
