TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS: The purpose of this notice is to satisfy two (2) separate but related procedural requirements for a project/activity to be undertaken by the Wheeling Housing Authority, WV.

REQUEST FOR RELEASE OF FUNDS
On or after Friday, August 20, 2021, the City of Wheeling will authorize the Wheeling Housing Authority to submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Capital Fund Program Grant Funds, Operating Funds, and General Funds under Section 9 of the U.S. Housing Act of 1937, to undertake a project / activity funded by the Wheeling Housing Authority for the purpose of demolishing the duplex structure and clearing the site located at 306-308 West Street, Wheeling, WV 26003.

ASSESSED PROJECT
306-308 West Street – Demolition/Clearance. The Wheeling Housing Authority (WHA) will utilize its non-Federal central office funds to demolish the duplex structure and clear the site at 306-308 West Street, Wheeling, WV 26003. Once cleared, the WHA will manage the site as open space for neighborhood residents. The total estimated project / activity cost is $25,000.00. The anticipated project / activity start is Calendar Year 2021, and the anticipated project/activity completion is Calendar Year 2022. This activity is assessed under HUD regulations at 24 CFR Part 58. Additional project information is contained in the respective Environmental Review Record (ERR) located at and available for review as listed under the FONSI Notice below.

FINDING OF NO SIGNIFICANT IMPACT (FONSI)
The City of Wheeling has determined that the above-identified project/ activity will have no significant impact on the human environment. Therefore, an Environment Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the respective ERR on file at the City of Wheeling Department of Economic and Community Development, 1500 Chapline Street, Wheeling, WV 26003, and at the Wheeling Housing Authority, 11 Community Street, Wheeling, WV 26003, and is available for public examination and copying, upon request, during normal business days Monday through Friday, from 9 a.m. to 4 p.m.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Wheeling Department of Economic and Community Development, 1500 Chapline Street, Wheeling, WV 26003. All comments received by Thursday, August 19, 2021 will be considered by the City of Wheeling prior to authorizing submittal of a request for release of funds. Commenters should specify which of the two (2) Notices provided herein they are addressing.

ENVIRONMENTAL CERTIFICATION
The City of Wheeling certifies to HUD that Mr. Robert Herron, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Wheeling Housing Authority to undertake this project/activity.

OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Wheeling’s certification received by Monday, September 6, 2021, or a period of fifteen (15) days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the City of Wheeling; (b) the Wheeling Housing Authority has omitted a step or failed to make a decision or finding required by HUD regulations 24 CFR Part 58; (c) the Wheeling Housing Authority or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or, (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project/activity is unsatisfactory from the standpoint of environmental quality.
