ORDER OF PUBLICATION
The object of the above-entitled action is to establish the ownership interest in Lot No. 5 of Block No. 29 of the Townsite of Norton in Roaring District, Randolph County owned by Bernard Earl Allender, now deceased, and for the Court to enter an Order granting the Plaintiff a lien against the subject property in the amount of the contractor’s costs in remediating unsafe or unsanitary conditions on the subject property, and to order and decree the sale of the subject property to satisfy the lien, as well as the other relief requested in the Complaint filed with the Court.
And it appearing by an affidavit filed in this action that counsel for the Plaintiff has used due diligence, but has been unable to determine if there may be persons, other than those named in the Complaint as Plaintiff and Defendants interested in the subject matter of the action, whose names are unknown to the Plaintiff and who are made Defendants by the general description of the Unknown Heirs of Bernard Earl Allender and the Unknown Heirs of Johanna Kess Allender.
It is ORDERED that Unknown Heirs of Bernard Earl Allender and the Unknown Heirs of Johanna Kess Allender do serve upon Robert C. Chenoweth and Peter G. Zurbuch, the Plaintiff’s attorneys, whose address is P.O. Box 1819, Elkins, West Virginia 26241, an answer or other defense to the Petition filed in this action on or before September 24, 2021, otherwise judgment by default will be taken against you at any time thereafter. A copy of said Complaint can be obtained from the undersigned Clerk at his office.
