This will give notice that BONNIE CROSS, RONALD CROSS, and KARAH CROSS has filed a COMPLAINT in the Circuit Court of Wood County, West Virginia, to obtain an award against the Defendant, DONALD JOSEPH, jointly and severally, for the debilitating and permanent injuries to BONNIE CROSS and KARAH CROSS as a result of an automobile accident that occurred on 06/07/20. Said injuries have caused Plaintiffs, BONNIE CROSS and KARAH CROSS, a loss of enjoyment of life, pain and suffering, and mental anguish. Plaintiffs request any relief a jury of the Defendant’s peers considered to be fair and just, punitive damages due to the nature of the Defendant’s conduct, plus pre-judgment interest, post-judgment interest and costs and any further relief appropriate under the facts and circumstances of this case.

DEFENDANT:
It appears by Affidavit filed in this action that Plaintiffs have made a good faith effort to locate the Defendant in order to serve him with a Summons and Complaint in accordance with the Rules of Civil Procedure. Plaintiffs have had considerable difficulty locating DONALD JOSEPH as the Defendant, DONALD JOSEPH, may not be residing at the address listed on the traffic report. Counsel has attempted service upon DONALD JOSEPH via the services of a process server who has made numerous attempts to locate DONALD JOSEPH, in Wood County, WV. All attempts resulted in a vacant home.
It is ORDERED that DONALD JOSEPH serve upon Richard D. Dunbar, Plaintiffs’ attorney, whose address is PO Box 123, Parkersburg, WV 26102, an Answer or other defense to the Complaint filed in this action on or before thirty (30) days from the date of this Publication. Otherwise, judgment by default will be taken against DONALD JOSEPH at any time thereafter. A copy of said COMPLAINT can be obtained from the undersigned Clerk at his/her office.
