To: The Parkersburg Area Diabetes Association, any unknown person or entity who would claim an interest in property gifted, bequeathed and/or devised in trust for the benefit of the trust for the benefit of the Parkersburg Area Diabetes Association, and all of their unknown heirs, successors assigns.
Petitioner, United Bank, has filed a PETITION TO MODIFY TRUST PROVISION IN FAVOR OF THE PARKERSBURG AREA DIABETES ASSOCIATION in the above entitled civil action, the object of which is to obtain an Order of court modifying remainder trust provision set forth under the Last Will and Testament of Violet M. Fletcher, Deceased, in favor of the Parkersburg Area Diabetes Association, so that such provision shall instead benefit the charitable component “field of interest fund” under PACF, Inc. d/b/a/ Parkersburg Area Community Foundation titled “Public Health Initiatives – Diabetes Prevention Fund”.
It appearing by affidavit filed in this action that the current whereabouts of the Parkersburg Area Diabetes Association (if any) are verily unknown and there are or may be persons or entities who would claim an interest in property gifted, bequeathed and/or devised in trust for the Parkersburg Area Diabetes Association, whose names and whereabouts are unknown to Petitioner and/or who may be non-residents of the State of West Virginia, and the Petitioner having made diligent but futile efforts to locate some of all of said persons or entities; it is accordingly ORDERED that each of them do appear and serve upon William Crichton VI, Lawyer, whose address is 325 9th Street, Parkersburg, West Virginia, 26101, an answer, response or other defense to the PETITION TO MODIFY TRUST PROVISION IN FAVOR OF THE PARKERSBURG AREA DIABETES ASSOCIATION filed in this action on or before November 1, 2021, otherwise judgment by default will be taken against them at any time thereafter.
A copy of said PETITION TO MODIFY TRUST PROVISION IN FAVOR OF THE PARKERSBURG AREA DIABETES ASSOCIATION can be obtained from the undressing Circuit Clerk at her office located at 2 Government Square, Parkersburg, Wood County, West Virginia.
