The object of the above-entitled action is to obtain damages and other compensation for Breach of Contract, Breach of Implied Warranty and Negligence. It appearing by an affidavit filed in this action that the Defendant can not be located and/or is avoiding service of process despite an attempt by certified mail pursuant to Rule 4(d)(1)(D) of the West Virginia Rules of Civil Procedure.
It is ordered that Darek Brown do serve upon the Wood County Magistrate Court Clerk, Paulina Yearago, at 401 Second Street, Parkersburg, WV 26101, and Plaintiff David Poske via his attorney John N. Ellem at PO Box 322, Parkersburg, WV 26102, an answer or other defense to the complaint filed in this action on or August 31, 2021, on or before November 19, 2021, otherwise judgment by default will be taken against the Defendant at any time thereafter. A copy of said complaint can be obtained from the undersigned clerk at their office.
