NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 14, 2003, executed by Borrower, Jessica Dawn Adams formerly known as Jessica Dawn White and Jay S. Adams, husband and wife, to Janet Phillips, the Trustee of record in the office of the Clerk of the County Commission of Hancock County, West Virginia, in Book 486, at Page 276. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of
509 Kitchel Avenue,
Newell, WV, 26050.
WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 16, 2021, of record in the Clerk’s Office in Book 881, Page 813. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Hancock County, in New Cumberland, West Virginia, on the following date:
19th day of November, 2021
at 1:00 p.m.
Those certain tracts or parcels of land known as and being Lot No. 5 and the Westerly part of Lot No. 4 on the Newell Heights Plan of Lots, situated in the District of Grant, County of Hancock and State of West Virginia, and recorded in Plat Book No. 1 at page 237 of the records of plats in Hancock County, West Virginia, and more particularly bounded and described as follows: Beginning at the northeast corner of Lot No. 5 said corner being south 55 degrees 30′ West 270 feet from the intersection of the southerly line of Kitchell Avenue and Westerly line of Water Street; thence South 55 degrees 30′ West 67.5 feet to the northwest corner of said Lot No. 5; thence south 43 degrees 30′ East 130 feet to a point in the north line of a 20 foot alley; thence North 55 degrees 30′ East 67.5 feet to the south-east corner of said Lot No. 5; thence along the southerly line of Lot No. 4 North 55 degrees 30′ East 12.5 feet to a point in the northerly line of a 20 foot alley; thence North 31 degrees 15′ West 130.3 feet to a point in the Northerly line of said Lot No. 4; thence south 55 degrees 30′ West 16.5 feet to the place of beginning and containing 0.24 acres more or less.
Being the same property conveyed to William E. White and Kathryn V. White, from Harry Milkton Grant and Amanda Grant, Husband and Wife as set forth in Book 109 Page 153 dated 05/09/1960 and recorded 05/25/1960, then from the Estate of Kathryn Virginia White to William E. White and Jessica Dawn White as set forth in Estate WB 23-316, Recorded 4/26/1996, Then from the Estate of William E. White aka William E White, Jr. to Jessica Dawn White as set forth in Estate WB 34-69, Recorded 07/16/2003, Hancock County Records, State of West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code sec 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
