Defendants.

The object of this action is for this Court to determine the Petitioner’s right to condemn and appropriate for said public purpose the land indicated and described herein; that the Court will permit said land sought to be condemned to be at once entered upon, possessed, appropriated and used, for the purposes stated in the Petition; that Commissioners be appointed to ascertain a just compensation to the owner or owners thereof, and other persons (lienors or otherwise) interested therein, for such land herein described and proposed to be taken, appropriated and used, for the public purposes and uses, aforesaid, together with damages, if any, to the residue of the respective tracts from which the said parcels sought to be acquired are respectively taken, beyond all benefits, if any, which may be derived in respect to such residue, for the purposes to which the parcels are to be taken, appropriated and used; that such other and further proceedings may be had in the premises as shall conform to the law, and that upon the payment of the compensation and damages thus or to be ascertained, a right of entry be issued; that land, may be vested in the Urban Renewal Authority of the City of Parkersburg, a public corporation, and that Petitioner may be granted such, other, further, general and special relief in the premises as shall seem meet and proper to this Honorable Court.
The parcel of land subject to this proceeding is more particularly bounded and described as follows:

Situate in the City and District of Parkersburg, Wood County, West Virginia, commonly known as 1106 24th Street, and more particularly described as follows:

BEGINNING at a stake in the Southerly line of 24th Street, said stake being the common line between Lots 10 and 11 of the Addition hereinafter named, thence South 24 Degrees 58′ West 75.15 feet to a point; thence South 64 degrees East 50 feet to a point in the common line of Lots 9 and 10 of the Addition hereinafter named; thence with the common line North 24 degrees 58′ East 75.15 feet to a point in the Southerly line of 24th Street; thence with he line of 24th Street North 64 degrees West 50 feet to the place of beginning, being the Northerly portion of Lot 10 of J.W. Dudley Addition to the City of Parkersburg, as shown on a plat thereof record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book No. 71, at page 506, and being the same property conveyed to Ernest Barker by Rick Barker dated the 4th day of May 2012 and recorded in Deed Book 1183 at page 486.

To the Defendant(s) Ernest Barker and Unknown Person(s):

It appearing by Affidavit filed in this action that the last known address(es) for Defendant(s) Ernest Barker and for any unknown person(s) who may have an interest are unknown and that no other address(es) of residency(ies) are known, it is hereby ordered that Defendant(s) Ernest Barker and any unknown person(s) serve upon Robert K. Tebay III, Assistant City Attorney, City of Parkersburg, whose address is Post Office Box 1627, Parkersburg, West Virginia, 26102, an Answer, including any related counterclaim or defense you may have to the Petition filed in this action on or before the 12th day of November, 2021. If you fail to do so, thereafter judgment, upon proper hearing, may be taken against you for the relief demanded in the Petition.
