NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated August 20, 2014, from James Filmore Dudley, aka James F. Dudley, Jr. and Janet Lee Dudley to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Randolph County, West Virginia in Trust Deed Book No. 528, at page 183, securing a promissory note in the principal amount of $103,551.75, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Randolph County Courthouse in Elkins, West Virginia, on December 1, 2021 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in Dry Fork District, Randolph County, West Virginia, lying south of West Virginia Secondary Route 29/2, Whites Run Road, together with any and all appurtenant easements which may benefit same:

Beginning at a 5/8″ rebar with cap set on or near the intersection of West Virginia Secondary Route 29/2, Whites Run Road, 30 foot right-of-way, and a grass alley, 16-foot right-of way; thence S. 07-45-00 E. 86.30 feet leaving said West Virginia Secondary Route 29/2, Whites Run Road, 30-foot right-of-way, and traveling with the western boundary of a grass alley, 16-foot right-of-way, to a set 5/8″ rebar with cap; thence S. 83-44-18 W. 53.97 feet leaving said grass alley, 16 foot right-of-way, and traveling into Dudley, DB 339/741, to a set 5/8″ rebar with cap; thence N. 10-33-23 W. 82.17 feet traveling to a 5/8″ rebar with cap set on or near the southern boundary of West Virginia Secondary Route 29/2, Whites Run Road, 30-foot right-of-way; thence N. 79-27-23 E. 58.04 feet, traveling with the southern boundary of West Virginia Secondary Route 29/2, Whites Run Road, 30-foot right-of-way, to the beginning, containing 0.11 acres, or 4,712.9 square feet, more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973 of Dailey, West Virginia, in June 1999.

Being the same property conveyed from Kristy L. Dudley to James F. Dudley, Jr. by Deed dated June 28, 2007, of record in the aforesaid Clerk’s office in Deed Book 517, at page 421.

Terms of sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
