NOTICE OF SUBSTITUTE TRUSTEE SALE

WHEREAS, by virtue of a trust deed dated January 18, 2019, made by Edward H. Staats, III and Nicolette D. Staats to Timothy R. Aiken, Trustee, of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 2052, page 837, said Trustee was empowered to sell the hereinafter described real estate pursuant to the terms and conditions set out in said deed of trust; and
WHEREAS, the said Trustee having been substituted by an Appointment of Substitute Trustee, dated November 4, 2021, recorded November 4, 2021, in the aforesaid Clerk’s office, in Trust Deed Book 2210, page 16, and executed by Jeremy M. Webb, its Vice President, and the undersigned Trustee, Robert D. Fisher, having been substituted therein by said Appointment of Substitute Trustee, and the grantor of the deed of trust having defaulted in the payment of a note secured thereby and the undersigned Trustee having been directed by the holder of said note to sell the real estate securing said note.
The undersigned Substitute Trustee will sell at public auction on

December 20, 2021,
commencing at 11:30 a.m.

at the front door of the Old Courthouse (facing Judicial Annex), situate in the City of Parkersburg, Wood County, West Virginia, all those certain lots, tracts or parcels of real estate situate, lying and being in Parkersburg District, Wood County, West Virginia, more particularly bounded and described as follows:

First Tract:

Beginning at a stone in Johnson’s line and corner to Paul Cook; thence with said Cook’s line N. 47 W. 17-7/100 poles to a stone pile, a corner to Lot No. 2; thence with a line of Lot No. 2, N. 7 E. 175 poles crossing the creek and road to a stone pile in another line of the Johnson land; thence with 2 lines of said land, N. 85 E. 14-25/100 poles to a stone pile, corner to Johnson; thence S. 7 W. 194 poles, re-crossing the road and creek to the beginning, containing 16-43/100 acres, and being what is known as Lot No. 1 in the petition of the estate of Joseph Lyons, made under a decree of the Circuit Court of Wood County, West Virginia, entered on the 6th day of April 1877, and recorded in the Office of the Clerk of the County Commission of Wood County on the 25th day of March, 1882, in Deed Book No. 45, page 168.

Second Tract:

Beginning at a stone pile in Cook’s line corner to Lot No. 1 of this division; thence with Cook’s line N. 47 W. 18-85/100 poles to a stone pile, corner to lands assigned as dower; thence with a line of the same N. 7 E. 160 poles crossing the creek and road to a stone pile in Johnson’s line; thence with the same N. 85 E. 15-75/100 poles to a stone pile, corner to Lot No. 1; thence with a line of the same S. 7 W. 175 poles, re-crossing the creek and road to the beginning, containing 16-48/100 acres, and being what is known as Lot No. 2 in the petition of the estate of Joseph Lyons, made under a decree of the Circuit Court of Wood County, West Virginia, entered on the 6th day of April 1877, and recorded in the Office of the Clerk of the County Commission of Wood County on the 25th day of March, 1882, in Deed Book No. 45, page 168.

There is EXCEPTED and RESERVED all the land situate north of the Old St. Marys Pike, containing 7 acres, more or less, as described in that certain deed executed by W.C. Defibaugh and Celia Defibaugh to Agnes Cox and recorded in the aforesaid Clerk’s Office in Deed Book 383, page 390, to which deed reference is hereby made and had for a more particular description thereof.

This is the same real estate conveyed unto Edward H. Staats, III and Nicolette D. Staats by deed dated November 30, 2013, of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1207 at Page 700.

This sale is made subject to all oil, gas and other mineral reservations and sales, to all valid existing rights of way and easements and appearing of record.

This sale is made subject to all unpaid real estate taxes.

The undersigned trustee reserves the right to adjourn the sale from time to time by oral proclamation or other announcement at the aforesaid place of sale.
