NOTICE OF SALE
UNDER DEED OF TRUST

Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

January 5, 2022
11:00 a.m.

offer for sale certain property described in that certain deed of trust executed by JOHN A. LAMBERT, SR., and CASSANDRA LAMBERT to David H. Wilmoth and Rebecca L. McClung, as Trustees, which deed of trust is dated the 13th day of June, 2014, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 525, at Page 31; and given to secure MOUNTAIN VALLEY BANK, N.A., the payment of a note therein described.

By Substitution of Trustee dated November 4, 2021, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 611, at Page 252, Jennifer L. Morgan was appointed Substitute Trustee.

The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction are that certain real property located at (address), (city), West Virginia, and more particularly described as follows:

All that certain tract or parcel of real estate situate on the south side of County Route 33/7, Weese Street, approximately 1.0 mile northeast of junction of County Route 33/7 and US 33/US 219, in Leadsville District, Randolph County, West Virginia, and is particularly bounded and described as follows:
Beginning at Corner 1, the northeast corner of the Parcel, a point in the southerly right of way limits of County Route 33/7, Weese Street, a corner common to Teresa L. Sacks, Randall L. White, and Jesse W. White (DB475/264), from which a 5/8 inch rebar with plastic cap bears S 14* 35′ 56″ W 3.00 feet as a reference
Thence southwesterly common to Teresa L. Sacks, Randall L. White, and Jesse W. White (DB 475/264), one (1) line:
S 14* 35′ 56″ W 233.63 feet to Corner 2, a 5/8 inch rebar with plastic cap set, common to Teresa L. Sacks, Randall L. White, and Jesse W. White (DB 475/264)
Thence northwesterly through the original tract, one (1) line:
N 34* 50′ 24″ W 211.50 feet to Corner 3, a 5/8 inch rebar with plastic cap set in the southerly right of way limits of County Route 33/7, Weese Street, from which a fire hydrant bears N 64* 26′ 09″ E 21.00 feet as a reference
Thence northeasterly with the southerly right of way limits of County Route 33/7, Weese Street, one (1) line:
N 73* 42′ 59″ E 187.22 feet to Corner 1, the place of beginning, containing 0.42 acres as surveyed by Evenwood Engineering PLLC, Bowden, WV and assisted by Jackie Isner PS #2068 of Rocky Run Surveying, Bowden, WV in June 2013.

And being the same real estate conveyed to John A. Lambert, Sr., by Charlotte L. Lambert, by virtue of a deed dated August 2, 2013, and of record in the Office of the Clerk of the County Commission Randolph County, West Virginia, in Deed Book 561, at Page 30.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
