NOTICE TO POSSIBLE CLAIMANTS OF $3, 210.00 IN UNITED STATES CURRENCY BY CORPORAL D.T. STALLINGS OF THE WEST VIRGINIA STATE POLICE ON OCTOBER 18, 2021
On October 18, 2021, Corporal D.T. Stallings, of the West Virginia State Police conducted an investigation regarding Emily Ann Swecker committing the offense of Possession With Intent to Deliver a Controlled Substance, pursuant to W.Va. Code section 60A-4-401(a)(i) and, pursuant to that investigation, seized in $3,210.00 in United States Currency. Said property was found in the actual or constructive possession of Emily Ann Swecker.
On the 18th day of October, 2021, during an investigation performed in Randolph County, West Virginia, Corporal D.T. Stallings found and seized numerous items including in $3,210.00 in United States Currency.
The Petitioners believe that the said in $3,210.00 in United States Currency is subject to seizure and forfeiture, pursuant to the West Virginia Contraband Forfeiture Act (W.Va. Code sections 60A-7-703 and 704), and that said in $3,210.00 in United States Currency was used to facilitate the sale, receipt, possession, manufacturing, possession with intent to deliver, and/or delivery of controlled substances in violation of Chapter 60A of the Code of West Virginia.
Petitioners seek an Order from the Circuit Court of Randolph County, West Virginia that the said in $3,210.00 in United States Currency be forfeited to the State of West Virginia and ownership of said property be vested in the State of West Virginia; that, thereafter, it be disposed of according to law.
Any claimant to the above referenced property being in $3,210.00 in United States Currency has a right to file a claim on or before January 31, 2022 Any claim must clearly state the identity of the claimant and an address where legal process can be served upon them and must be filed with the Circuit Clerk of Randolph County, West Virginia.
