NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated December 12, 2007, executed by Borrower(s), Robert Ong and Virginia Ong, to Thomas R. Ross II, the Trustee of record in the office of the Clerk of the County Commission of Randolph County, West Virginia, in Book 437, at Page 163. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Route 219 Parsons Rd, Montrose, WV 26283. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 18, 2021, of record in the Clerk’s Office in Book 612, Page 415. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Randolph County, in Elkins, West Virginia, on the following date:

February 18, 2022 at 5:15 p.m.

Those certain parcels of land, lying and being in Leadsville District, Randolph County, West Virginia, bounded and described as follows: PARCEL ONE: Beginning at the old county road, thence N. 81 40 W. 352.55 feet to a concrete marker, thence N. 16 02 E. 72.73 feet to a concrete marker, thence S. 81 40 E. 344.25 feet to a point in the old county road, thence with the old county road S. 9 20 W. 72 feet to the place of beginning, containing 91/160 acre. LESS AND EXCEPT: That certain strip or parcel of land together with all rights and privileges thereto belonging, conveyed to the State of West Virginia, by the State Road Commission, a Corporation, by Donna V. Geyer and Charles W. Geyer, her husband, by deed dated the 9th day of July, 1953, and recorded in the aforesaid Clerk’s Office in Deed Book 197 at page 203, more particularly described as follows: Beginning at a point in the westerly right of way for Project F 285 (3), Gilman Bridge & Approaches, U.S. Route 219, as is referenced on plans on file in the Office of the Clerk of the County Commission of Randolph County, West Virginia, said point being 30 feet left of Station 116+65.50; thence in a northerly direction with a curve to the right of 1939.86 feet radius concentric with and 30 feet left of centerline for a distance of 73.13 feet, more or less, to a point 30 feet left of Station 117+37.50, said point being in the property line between Donna V. Geyer, et als, and Cecil Wees, et als; thence along said property line S. 86′ 37′ E. for a distance of 4 feet, more or less, to a point 26 feet left of Station 117+37.50, said point being in the westerly right of way line of the existing road; thence in a southwesterly direction along the said right of way line for a distance of 72 feet, more or less, to a point 25 feet left of Station 116+65.50, said point being in the property line between Donna V. Geyer, et als, and Donald Vanscoy; thence along said property line N. 86 37 W. for a distance of 4 feet to the place of beginning, containing 288 square feet, more or less. PARCEL TWO: Beginning at a concrete marker in the westerly right-of-way line of U.S. Route 219 and 30 feet from the center line, said point being the present corner of Donna Vanscoy Geyer and Cecil and James Wees property, thence with the present property line of Donna Vanscoy Geyer and James Wees N. 80 30 W., a distance of 318.8 feet to another existing concrete marker which is the corner of Donna Vanscoy Geyer and James Wees line, N. 16 50 E., a distance of 45.0 feet to an iron pin, thence through the James Wees property, S. 78 47 E., a distance of 315.0 feet to an iron pin set in the above mentioned U.S. Route 219 right-of-way line, thence with the right-of-way line of U.S. Route 219, S. 12 59 W., a distance of 35.0 feet to the place of beginning, containing 0.30 acre, more or less. Being the same real estate conveyed to Robert Ong and Virginia Ong, husband and wife, by. Philip John Eisen and Marguerite Lynn McCallum Eisen and Barbara V. McCallum by deed dated the 12th day of December, 2007, and recorded in Deed Book 521 at Page 523 in the Office of the Clerk of the County Commission of Randolph County, West Virginia. This conveyance is expressly made subject to all prior reservations, restrictions, exceptions, easements, rights of way, covenants, conditions and limitations that may be found in instruments of record in the chain of title to said real estate.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code section 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
