NOTICE OF TRUSTEE’S SALE AND
SALE OF PERSONAL
PROPERTY

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Trustee will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

TUESDAY, MARCH 8, 2022,
at 10:00 o’clock in the
forenoon, local time,

at public auction, to the highest bidder for cash, all of the right, title and interest of JAMES H. WARE in and to the real property described in a certain deed of trust dated October 29, 2003, to RANDALL E. SNIDER and ANDREW WOOFTER (also known as Andrew C. Woofter, III), original Trustees, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 2022, at page 811 thereof, possessed by the said JAMES H. WARE as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:

All of that certain lot, tract or parcel of real estate lying and being situate in Tygart District, Wood County, West Virginia, more particularly described as follows:

BEGINNING at an iron rod (found) in the westerly line of a 40 foot wide right of way, said iron rod being the northeasterly corner of J. Daggett (Deed Book 1017, at page 89); thence with the line of said Daggett, two (2) courses and distances; S. 62 degrees 17′ 32″ W. 356.14 feet to an iron rod (found); S. 66 degrees 20′ 12″ W. 230.70 feet to an iron rod (set); thence with the interior of the parent tract, three (3) courses and distances; N. 23 degrees 39′ 48″ W. 260.74 feet to an iron rod (set); N. 54 degrees 48′ 34″ E. 633.92 feet to a 20 inch diameter poplar tree; S. 82 degrees 28′ 46″ E. 204.96 feet to an iron rod (set) in the westerly line of said 40 foot wide right of way; thence with the westerly line of said 40 foot right of way, four (4) courses and distances; S. 09 degrees 39′ 28″ W. 37.69 feet to an iron rod (set); S. 16 degrees 07′ 23″ W. 199.29 feet to an iron rod (set); S. 18 degrees 46′ 27″ W. 88.25 feet to an iron rod (set); S. 00 degrees 44′ 30″ E. 6.88 feet to the point of beginning and containing 5.142 acres, more or less.

There is EXCEPTED and RESERVED and not conveyed hereby that certain 0.610 acre tract conveyed unto Jeffrey N. Daggett by deed dated January 30, 2013 and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1193, at page 720. The net acreage of the property conveyed hereby is now believed to be 4.532 acres, more or less.

There is also hereby conveyed a 40 foot right of way or easement for purposes of ingress, egress and regress from Pleasant View Road to the real estate hereinabove conveyed, the centerline of which begins at a point on Pleasant View Road 20 feet southerly of the southwest corner of the Theresa Wright tract (Deed Book 305, at page 199) and contains the following courses and distances: N. 31 degrees 27′ E. 512.7 feet from the centerline of Pleasant View Road; N. 11 degrees 10′ E. 56.8; N. 27 degrees 37′ W. 107.5 feet; N. 4 degrees W. 112.8 feet; 29 degrees 50′ W. 120.5 feet; and N. 51 degrees 19′ W. 145 feet all as shown on the plat of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, aka Barnstable Drive.

Being a part of the same real estate conveyed unto Robert A. Sturm and Monica J. Sturm, by deed dated September 27, 2011, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1174 at page 464 and the same property conveyed unto Robert A. Sturm and Monica J. Sturm by straw deed dated October 9, 2015 and of record in Deed Book 1236, at page 306.

This conveyance is made subject to any and all exceptions, agreements, restrictions, covenants, easements and rights of way set forth in prior deeds of record.

AND believed to have a mailing address of 297 Barnstable Drive, Parkersburg, West Virginia.
There is present on said real estate certain 2005 Giles Mobile Home Pinnacle Model 246 unit of manufactured housing, serial number GI27690, and the undersigned, as agent of the secured party, Community Bank of Parkersburg, will offer said unit of manufactured housing for sale at public auction on the date, time and place set forth above and under the same terms and conditions.
The following terms will apply to said sale, to-wit:
1. Minimum acceptable bid is $60,100.00, of which the sum of $2,500.00 by Bank or Cashier’s check must be delivered at the sale, with the balance due within 14 days or as the Trustee and bidder(s) may otherwise agree at sale.
2. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon.
3. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned, and further reserves the right to alter the terms of sale at any such continued sale, including, but to limited to, a lower minimum bid.
4. The undersigned reserves the right to reject any and all bids.
5. Sale is subject to unpaid ad valorem taxes and special assessments, if any.
6. The premises and the unit of manufactured housing described hereinabove, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied.
7. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
8. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
9. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the Trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
10. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
11. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
12. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
