ORDER OF PUBLICATION
To: The above-named Respondents, and all of their personal representatives, heirs, beneficiaries, creditors, successors and assigns, if any.
The object of the Petition for Declaratory Judgment filed in this action is to obtain certain judicial declarations regarding the “Testamentary Trust” set forth under the Last Will and Testament of Helen A. Thrasher, Deceased (which said instrument was probated and is of record in the Office of the Clerk of the County Commission for Wyoming County, West Virginia), including, without limitation, declarations determining and identifying all of the persons and/or entities properly entitled to receive final distributions of the trust estate of the subject Testamentary Trust and declarations determining the manner (and amounts) in which the final distributions of the trust estate of the Testamentary Trust shall be properly divided, apportioned and distributed.
It appearing by Affidavit filed in this action that the whereabouts of some or all of the above named Respondents, and/or their personal representatives, heirs, beneficiaries, creditors, successors and assigns, if any, are unknown and/or that such individuals or entities are non-residents of the State of West Virginia; that there are or may be persons other than those named above who are interested in subject Testamentary Trust, whose names are unknown to Petitioner, and who are made parties to the Petition for Declaratory Judgment filed in this action by the general description of unknown Respondents, and the Petitioner having made diligent but futile efforts to locate some or all of said Respondents; it is accordingly ORDERED that each of them do appear and serve upon William Crichton VI, Lawyer, whose address is 511 28th Street, Vienna, West Virginia 26105-1451, an answer or other defense to the Petition for Declaratory Judgment filed in this action on or before the 10th day of May, 2022, otherwise judgment by default will be taken against them at any time thereafter.
A copy of said Petition for Declaratory Judgment can be obtained from the undersigned Clerk at her office located in the Holmes R. Shaver Wood County Judicial Annex, 2 Government Square, Parkersburg, Wood County, West Virginia.
