Activity:
The State of West Virginia promulgated 33 CSR 1B of the Legislative Rules effective March 1, 2022. The application of the requirements of the new rule, as well as additional data concern a multi-port diffuser, was submitted by the permittee during the comment period. This required several revisions to the draft permit. The changes are detailed in the attached revised draft permit and fact sheet addendum. The agency will only accept comments on application of the site-specific mixing zone and revise of Section D during the new comment period.

Coal combustion byproduct disposal facility for ash, FGD, and other materials generated at Pleasants, Willow Island, Albright, Fort Martin, Harrison, and Rivesville power stations.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:
