Activity:

To operate and maintain an existing wastewater collection system and an existing 1.75 million gallons per day wastewater treatment plant.  The facilities are to serve a population equivalent of approximately 17,500 persons in the City of Charles Town, Jefferson County Public Service District, the City of Ranson, and environs, and discharge treated wastewater through Outlet No. 001 to Evitts Run of the Shenandoah River of the Potomac River.  An antidegradation review has been conducted. Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6.  Also, to accept nondomestic wastewater from the Charles Town water treatment plant for subsequent treatment and disposal at Outlet No. 001.  To operate and maintain an existing wastewater collection system and an existing 0.5 million gallons per day wastewater treatment plant.  The facilities are to serve a population of approximately 1250 housing units at the Tuscawilla Hills Subdivision and Locust Hills area and discharge treated wastewater through Outlet No.002 to the Tuscawilla West Golf Course pond/irrigation system with ultimate discharge through Outlet No. 203 to Evitts Run, approximately 7.6 miles from its mouth, of the Shenandoah River of the Potomac River.  Tier 2 protection is afforded for all parameters of concern requiring that protection for Outlet No. 203.  The agency has made a determination that the proposed activity will not cause significant degradation to the receiving stream.  Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plants.  Sewage sludge generated and/or processed at the permittee’s facilities shall be land applied, provided that the sewage sludge shall not be applied in a manner that exceeds the agronomic or lifetime loading rates.  These land application site(s) meet all other regulatory standards and is identified as follows:  J. P. and Richard Burns, located at One Burns Farm Lane, Charles Town, WV.  Further, sewage sludge generated and/or processed at the permittee’s facilities shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.   Also, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of by the permittee and/or a registered septage hauler.  Further, the requirements for the Chesapeake Bay Total Maximum Daily Loads are being implemented.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.

Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice.  Such comments or requests should be addressed to:

The public comment period begins April 27, 2016 and ends May 27, 2016.

Comments received within this period will be considered prior to acting on the permit application.  Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised.  The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s).  Interested persons may contact the public information office to obtain further information.

The application, draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days.  Copies of the documents may be obtained from the Division at a nominal cost.  Calls must be made 8:30 a.m. to 4:30 p.m. Monday through Friday.
